DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals on
Thursday, July 9, 2009, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket,
Massachusetts, the Board made the following Decision on the Application in
Zoning Board of Appeals File No. 025-09 of Michael Day and Jessica Gage, of 6
Corby Way, Nantucket, MA 02554.
2. Applicants are requesting Special Permit relief pursuant to
Nantucket Zoning Bylaw Section 139-16.C.(1) (intensity regulations) to reduce
the side yard setback from ten (10) feet to five (5) feet to validate the siting of the
porch. The porch is located 9.5 feet from the side yard setback in a zoning
district that requires a ten (10) foot side yard setback. The site is located at 6
Corby Way, is shown on Nantucket Tax Assessor's Map 67 as Parcel 761, is
shown on Plan No. 2004-20 and is recorded at the Nantucket County Registry of
Deeds in Book 1100, Page 115. The site is zoned Residential -10.
3. Our Decision is based upon the Application and accompanying
materials, representations and testimony received at our public hearing. The
Planning Board recommended that the board grant the requested relief. No
abutter comment was received either in favor of or against the Application.
4. The Applicants represented themselves at the hearing. The
Applicants informed the Board that they are requesting a Special Permit
pursuant to Nantucket Zoning Bylaw Section 139-16.C.(1) to reduce the ten (10)
foot side yard setback to five (5) feet in order to validate an enclosed front porch
sited 9.5 feet from the boundary line. The Applicants also informed the Board
that the lot is long and skinny and there is little space on either side. When the
house was relocated from another location, the contractor did not realize the
porch would be included and subsequently, the foundation was improperly sited
by the surveyor.
5. The Board finds that the burden of correcting the intrusion
substantially outweighs any benefit to an abutter of eliminating the intrusion.
However, after discussion, the Board does not feel that the setback reduction to
five (5) feet is necessary in this instance. There is an existing driveway easement
running along the side of the property, and granting a five (5) foot setback would
create a possibility of problems arising in the future. Therefore, the Board finds
that the issuance of a special permit to only validate the 6 inch intrusion of the
porch under these circumstances is in harmony with the general purpose and
intent of the Zoning Bylaw.
6. Accordingly, by a motion made and duly seconded to GRANT the
requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw
Section 139-16(C)(I) to reduce the side yard setback from ten (10) feet to nine and
one half (9.5) feet to validate the siting of the porch located 9.5 feet from the side
yard setback with the condition that no further construction of structures, nor
additions to the existing structure, shall take place within ten feet of the side yard
lot line without the issuance of further relief by the Board of Appeals, as shown
on the plan entitled "Mortgage Inspection Plan in Nantucket, MA", prepared by
Charles W. Hart and Associates, Inc. dated June 3, 2009, and attached as Exhibit
A, there were five (5) votes in favor and none (0) opposed.
