NANTUCKET ZONING BOARD OF APPEALS 2 Fairgrounds Road Nantucket, Massachusetts 02554 61 Bartlett Road Assessor's Map 66, Parcel 99 Lot 7, Plan No. 05-13 Book 698, Page 109 Residential - 20 DECISION: 1. At a public hearing of the Nantucket Zoning Board of Appeals on Thursday, July 9, 2009, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following Decision on the Application in Zoning Board of Appeals File No. 024-09 of Donald E. Dimock, of 44 Bartlett Road, Nantucket, MA 02554. 2. Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-16.C.(1) (intensity regulations) to reduce the side yard setback from ten (10) feet to five (5) feet to validate the siting of his shed. The shed is located as close as 9.5 feet from the side yard setback in a zoning district that requires a ten (10) foot side yard setback. The site is located at 61 Bartlett Road, is shown on Nantucket Tax Assessor's Map 66 as Parcel 99, is shown on Plan File 05-13 as Lot 7, and is recorded at the Nantucket County Registry of Deeds in Book 698, Page 109. The site is zoned Residential- 20. 3. Our Decision is based upon the Application and accompanying materials, representations and testimony received at our public hearing. The Planning Board recommended that the board grant the requested relief. No abutter comment was received either in favor of or against the Application. 4. The Applicant represented himself at the hearing. The Applicant informed the Board that he is requesting a Special Permit pursuant to Nantucket Zoning Bylaw Section 139-16.C.(1) to reduce the ten (10) foot rear yard setback to five (5) feet in order to validate a shed sited 9.5 feet from the northerly boundary line. 5. The Board finds that the burden of correcting the intrusion substantially outweighs any benefit to an abutter of eliminating the intrusion. Therefore, the Board finds that the issuance of a special permit to only validate the 6 inch intrusion of the porch under these circumstances is in harmony with the general purpose and intent of the Zoning Bylaw. 6. Accordingly, by a motion made and duly seconded to GRANT the requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw Section 139-16(C)(1) to reduce the rear yard setback from ten (10) feet to nine and one half (9.5) feet to validate the siting of the porch located 9.5 feet from the side yard setback with the condition that no further construction of structures, nor additions to the existing structure, shall take place within ten feet of the side yard lot line without the issuance of further relief by the Board of Appeals, as shown on the plan entitled "Building Location Plan of Land in Nantucket, Mass", prepared by Charles W. Hart and Associates, Inc. dated May 21, 2009, and attached as Exhibit A, there were five (5) votes in favor and none (0) opposed.
