18 Dukes Road
Doerte Neudert (Applicant), of 18 Dukes Road, Nantucket, seeks a Special Permit
pursuant to 139-16 C. (1) to reduce the side lot setback requirement pertaining to Locus in this
Residential-20 zoning district from 1 0 feet to an amount less that 10 feet but only to the extent
necessary to validate the siting of a rear yard storage shed.
Locus is located in the Residential-20 Zoning District under the Nantucket Zoning By-
law (the "By-law"). The Premises is improved by a single family dwelling containing an
accessory apartment and rear yard storage shed.
The Premises is conforming as to lot area, containing about 20,021 +/- square feet where
a minimum of 20,000 square feet is required, and otherwise conforms to all requirements of the
R-20 zoning district, including frontage, having frontage on Dukes Road in excess of the 75 feet
required in the District.
Applicant's request is meritorious and the relief requested may be granted without
derogating from the health, safety, convenience, morals and general welfare of the inhabitants of
neither the Town of Nantucket nor the Purpose of the By-Law.

DECISION:
I. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, June
11, 2009 at 1:00 P.M., in the garage area at 2 Fairgrounds Road, Nantucket, Massachusetts
02554, the Board made the following decision on the application DOERTE NEUDERT c/o
Vaughan, Dale, Hunter, Stetina, and Beaudette, P.C., PO Box 659, Nantucket, MA 02554, Board
of Appeals File No. 016-09.
2. Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw
Section 139-16.C.(1) (intensity regulations) to reduce the ten (10) foot rear yard setback to five
(5) feet in order to validate an existing shed sited as close as 8.8 feet from the southerly boundary
line. The site is located at 18 Duke's Road, is shown on Nantucket Tax Assessor's Map 41 as
Parcel 62, is shown as Lot 12 on Land Court Plan 36748-B, and is registered at the Nantucket
County Registry of Deeds as Certificate of Title No. 17700. The site is zoned Residential- 20.
3. Our decision is based upon the application and accompanying materials, and
representations, and testimony at our public hearing. The Planning Board made no
recommendation on the basis that no matters of planning concern were presented. One abutter
was represented by counsel at the hearing.
4. The Applicant, through counsel, stated that the Applicant is requesting Special
Permit relief pursuant to Nantucket Zoning Bylaw Section 139-16.C.(I) to reduce the ten (10)
foot rear yard setback to five (5) feet in order to validate the location of an existing shed. This
shed was constructed within the setback by a contractor. The shed in question is sited as close as
8.8 feet in a zoning district that requires a ten (10) foot setback. Accordingly, rather than
relocating the shed, the Applicant is asking for relief in order to reduce the setback in order to
validate the location of the shed.
Counsel for an abutter expressed concern that the Applicant would be utilizing the shed
for part of a home occupation use - or as a studio, a living area, a dwelling, or something other
than a storage shed. Under the revised zoning code, art galleries are no longer permitted as home
occupation uses and are not permitted in the Residential - 20 zoning district. The Board
appreciated these concerns and asked counsel for the Applicant whether there would be any
plans to utilize the space in the shed - or the dwelling - as an art gallery. Counsel for the
Applicant indicated that it was not the intention of the Applicant to have an art gallery on the
premIses.
5. Based on the foregoing, the Board finds that the requested relief would be III
harmony with the general purpose and intent of the Zoning Bylaw.
6. Accordingly, the Board of Appeals, by a vote of FOUR (4) in favor and one (1)
opposed (Toole), GRANTS the requested SPECIAL PERMIT relief to allow the siting of the
existing shed as shown on the plan entitled "Plot Plan to Accompany Zoning Board of Appeals
Application for #18 Duke's Road," dated March 16, 2009, prepared by Earle & Sullivan, Inc.,
attached as "Exhibit A" upon the following conditions:
a. Any improvements to the Premises that result in an increase in ground cover shall
require that the applicant bring the shed into compliance with the setback
requirements of the zoning district;
b. While the shed remains in the rear zoning yard, it shall not be heated or serviced by
water without further relief from this Board;
c. No home occupation use shall be permitted without further relief from this Board;
and,
d. The use of the shed shall be limited to storage purposes without further relief from
this Board.
