The applicant requests Special Permit relief under Nantucket
Zoning By-law ~139-16.C(1), as applicable in this Sconset
Residential-20 zoning district, to reduce the southerly side
yard setback, measured from Butterfly Lane, from ten feet to
five feet, in order to validate the reconstruction of the
porch and second story deck. Prior to the work, the porch was
about 8 feet from the southerly lot line, with a step about
6.6 feet from this lot line, each measured at the closest
point. The reconstructed porch is now about 7.5 feet from the
southerly lot line, with steps at about 5.5 feet from this lot
line, each measured at the closest point. The dwelling
otherwise complies with all setback requirements; the shed and
garage which intrude into the westerly rear yard setback, and
the total ground cover, which exceeds the maximum in this
zoning district, pre-exists the zoning requirement and has not
been changed. In the alternative, the applicant requests a
Special Permit under ~139-33 .A(4) for the already-completed
alteration of his pre-existing, nonconforming dwelling by
reconstructing the porch and deck as it now exists, extending
the pre-existing nonconformity in side yard setback.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, April 9, 2009, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of JAMES R. POOLE, c/o

2. The applicant requests relief by Special Permit under
Nantucket Zoning By-law ~139-16.C(1), or in the alternative under
~130-33.A(4), in order to validate the reconstruction of a porch,
under a second-story deck, at the applicant's single-family
dwelling, which is sited about 5.5 feet at the closest point from
the southerly side line of locus along Butterfly Lane; minimum
side yard setback in this zoning district is 10 feet. The locus
is situated at 4 Butterfly Lane, Siasconset, Nantucket Assessor's
Parcel 73.1.4 - 3 5, is shown upon plan recorded with Nantucket
Deeds in Plan Book 2, Page 22, as Lot 6, and is situated in a
Sconset Residential-20 zoning district.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
recei ved at our public hearing. There was no Planning Board
recommendation, on the basis that no matter of planning concern
was presented. Except for the presentation by the applicant's
counsel and contractor, no support nor opposition was presented
at the public hearing.

4. As presented by the applicant' s representatives, the
applicant performed work upon the pre-existing, nonconforming
single-family dwelling upon the locus, involving lifting the
structure and placing it upon a new foundation, without expansion
or change in location. The dwelling was nonconforming as to side
yard setback, with the porch, under second-story deck, being
si ted with the porch and deck about 8 feet from the southerly
side line along Butterfly Lane, and with a single step for access
to the porch extending to about 6.6 feet from the sideline of
Butterfly Lane. (The dwelling was, and is, conforming with all
other dimensional zoning requirements. Front yard setback, a
minimum of 30 feet required, is maintained from Baxter Road, as
is permitted for this corner lot. Other dimensionally
nonconforming structures upon locus also pre-exist applicable
zoning requirements in their present location.)
5. The applicant's contractor explained that, in the course
of construction, the existing deck structure collapsed under the
weight of two workmen and himself, resulting in serious personal
injury to him. Although it had not been planned to replace the
porch and deck, this accident necessitated that the work be done.
The contractor specified the location for the new porch and deck,
but the workers apparently expanded the structure toward the line
of Bayberry Lane by about six inches i and the porch floor was
elevated somewhat from its prior location, resulting in the need
for two steps where there had previously been one, so that the
setback of the steps at their closest point to Bayberry Lane is
about 5.5 feet, whereas the old step was about 6.6 feet from
Bayberry Lane. The previous and present conditions upon locus
are as shown upon two plans by Blackwell & Associates. Reduced
copies of the "before" plan, dated August 29, 2006 (revised March
9, 2009), and the "after" plan, dated March 9, 2009, are attached
to this decision as Exhibits A and B, respectively.
6. The Board of Appeals, as special permit granting
authority, is empowered by By-law ~139-16.C(1) to reduce side or
rear yard setback from ten feet to five feet in certain
districts, including the Sconset Residential-2 district in which
locus is situated, by Special Permit, with no criteria stated in
the By-law except the general special permit standard that relief
be in harmony with the general purpose and intent of the By-law.
7. Under the unusual circumstances in this case, and with
no opposition from neighbors, the Board of Appeals found that the
requested relief under ~139-16.C(1), to the limited extent
necessary to validate the siting of the existing structure, would
be in harmony with the general purpose and intent of the By-law,
and by UNANIMOUS vote GRANTED the requested relief under ~139-
16.C(1), to reduce the southerly side yard setback from ten feet
to five feet to the extent necessary to validate the existing

structure, only; upon the condition that no additional expansion
or construction shall take place closer than ten feet to the side
lot line without the granting of further relief by the Board of
Appeals.
