At a public hearing of the Nantucket Zoning Board of Appeals on Thursday, May 14, 2009, at 1:00 P,M., at 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following Decision on the Application in Zoning Board of Appeals File No. 012-09 of Peter Fletcher Haigh, Jr. and Ashley Christ, of 2 Greglen Ave, PO Box 195, Nantucket, MA 02554, 2, Applicants are requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139-16.C.(1) (intensity regulations) to reduce the ten (10) foot side yard setback to five (5) feet in order to validate an existing shed sited as close as 7.2 feet from the easterly boundary line, The site is located at 7 Roberts Lane, is shown on Nantucket Tax Assessor's Map 56 as Parcel 103, is shown in Plan Book 18, Page 140, and is recorded at the Nantucket County Registry of Deeds in Book 1155, Page 39, The site is zoned Residential- 20, 3, Our Decision is based upon the Application and accompanying materials, representations and testimony received at our public hearing. The Planning Board made no recommendation finding that the Application did not present any issues of planning concern. No abutter comment was received either in favor of or against the Application, 4. The Applicants represented themselves at the hearing, The Applicants informed the Board that they are requesting a Special Permit pursuant to Nantucket Zoning Bylaw Section 139-16,C.(I) to reduce the ten (10) foot side yard setback to five (5) feet in order to validate an existing shed sited as close as 7.2 feet from the easterly boundary line, The Applicants stated that they did not construct the shed in the setback. The shed was constructed by the former property owner. 5. Therefore, the Board finds that the burden of correcting the intrusion substantially outweighs any benefit to an abutter of eliminating the intrusion, The Board also finds that the issuance of a special permit to validate the siting of the shed under these circumstances is in harmony with the general purpose and intent of the Zoning By-law, 6, Accordingly, by a motion made and duly seconded to GRANT the requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw Section 139-16(C)(1) to reduce the side yard setback from ten (10) feet to five (5) feet to validate the siting of the shed located as close as 7,2 feet from the side yard setback with the condition that no further construction of structures, nor additions to the existing structure, shall take place within ten feet of the side yard lot line without the issuance of further relief by the Board of Appeals, as shown on the plan entitled "Mortgage Inspection Plan in Nantucket, MAli, prepared by Blackwell and Associates, Inc" dated October 3, 2008, and attached as Exhibit A, there were five (5) votes in favor and none (0) opposed.
