ADDENDUM "A"
The Applicants, Lyman S.A. Perry and Kate D. Perry, Co-Trustees of the Charitable
Remainder Unit Trust of Lyman S.A. Perry and Kate D. Perry dated December 31, 1997 and
recorded in Book 564, Page 133 at the Nantucket Registry of Deeds ("Perry") own the improved
residential real estate located at 78 Polpis Road, Nantucket, Massachusetts 02554 shown as Lot
13 on a Plan recorded in Plan Book 19, page 77 at the Nantucket Registry of Deeds ("Property").
The Property has an area of 45 ,906:t square feet and includes four (4) existing structures, all of
which were construction prior to January 1, 2000:
1. Primary Dwelling, 655:t square feet, Building Permit No. 1389-80, June 23, 1980;
2. Secondary Cottage, 540:t square feet, Building Permit No. 4307-85, August 20,
1985;
3. Garage/Studio, 264:t square feet, Building Permit No. 4237-85, July 11, 1985;
and
4. Raised Platform Tennis Court, 1,754:t square feet, Building Permit No. 1286-99,
December 16, 1999.
The aggregate ground cover ofthe existing structures on the Property is 3,212:t square
feet. The existing ground cover ratio is 6.99%. Until January 1, 2000, the Property was subject to
the zoning intensity regulations for lots located in LUG-l Zoning District and the Property
complied with all LUG-l zoning intensity regulations, including, but not limited to, the 40,000
square foot minimum lot size requirement (45,906:t sq. ft.), the one hundred (100') foot minimum
frontage requirement (198.47'); arid the seven (7.0%) percent maximum ground cover ratio
requirement (6.99%). As of January 1, 2000, however, the Property was subject to more stringent
LUG-3 intensity regulations, including, but not limited to, the 120,000 square foot minimum lot
size requirement, the two hundred (200') foot frontage requirement and the three (3%) percent
maximum ground cover ratio requirement. Currently, the Property is non-conforming as to lot
size, frontage, arid maximum ground cover ratio.
Perry seeks a Special permit under Section 139-33(9) of the By-law to demolish or
remove the existing cottage and paddle tennis court on the Property, to relocate, renovate and
convert the existing primary dwelling on the Property into a secondary dwelling, to relocate the
existing garage/studio on the Property, and to construct a new primary dwelling on the Property,
all in accordance with Nantucket Historic District Commission Certificates of Appropriateness
Nos. 53381 and 53382 issued on January 27,2009. The aggregate ground cover of the new
primary dwelling (2,015:tsq.ft.), secondary dwelling (541:t sq.ft.) and garage/studio (264:tsq.ft.)
is 2,820:t square feet (6.14%).
Perry asks the Board of Appeals to issue the requested Special Permit for this Project
pursuant to Section 139-33(9) of the By-law because the proposed removal or demolition ofthe
cottage and paddle tennis court and the reconstruction and renovation of the proposed new
primary dwelling, renovated secondary dwelling and relocation of the garage/studio will not
result in an aggregate ground cover of le,ss th(lll the existing ground cover of all existing
structures on the Property (3,220:t squ~ef~et),.all reconstructed and renovated structures shall
comply with LUG-3 set back requirements, and the proposed Project will not be substantially
more detrimental to the neighborhood than the existing structures on the Property. Specifically,
Perry will eliminate existing set back non-conformities and enhance the improvements on the
Property.
Perry asks the Board of Appeals to issue the requested Special Permit.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals on
Thursday, April 9, 2009, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket,
Massachusetts, the Board made the following Decision on the Application in
Zoning Board of Appeals File No. 011-09 of Kate D. Perry and Lyman S.A.
Perry, Co-Trustees of Charitable Remainder Unit Trust of Lyman S.A. Perry
and Kate D. Perry, of 311 North Newton Street Road, Newton Square, PA 19073.
2. Applicants are requesting Special Permit relief pursuant to Nantucket
Zoning Bylaw Section 139-33.A.(9) (removal and reconstruction of pre-existing,
nonconforming structures) to allow for the removal or demolition of the existing
paddle tennis court and cottage on the site, the relocation, renovation, and
conversion of the existing dwelling into a secondary dwelling on the site, the
relocation of the existing garage/ studio on the site, and the construction of a new
primary dwelling on the site. The proposed work on the property will eliminate
the existing setback non-conformities. The site is located at 78 Polpis Road, is
shown on Nantucket Tax Assessor's Map 44 as Parcel 25.7, is shown in Plan Book
19, Page 77 as Lot 13, and is recorded at the Nantucket County Registry of Deeds
in Book 561, Page 76. The site is zoned Limited Use General - 3.
3. Our Decision is based upon the Application and accompanying
materials, representations and testimony received at our public hearing. The
Planning Board made no recommendation finding that the Application did not
present any issues of planning concern. No abutter comment was received either
in favor of or against the Application; however, the abutter to the east of the
locus did make inquiries prior to the meeting to better understand the nature
and specifics of the project.
4. Attorney Kevin Dale represented the Applicants at the hearing.
Attorney Dale explained that the aggregate ground cover of the existing
structures on the locus is 3,2122:. square feet, with an existing ground cover ratio
of 6.99%. Until January 1, 2000, the locus was subject to the zoning intensity
regulations for lots located in the Limited Use General-l (LUG-I) zoning
district. Accordingly, the locus and the structures thereon conformed to all
intensity regulations of the LUG-l zoning district. As of January 1, 2000, the
locus was subject to the more stringent Limited Use General - 3 (LUG-3)
intensity regulations. Under the LUG-3 intensity regulations, the locus is
nonconforming as to lot size, frontage, and maximum ground cover ratio.
Attorney Dale further stated that the Applicants are requesting to
demolish and construct a new primary dwelling, a secondary dwelling, and a
garage/ studio. The aggregate ground cover of the new structures will be 2,820 :t
square feet, with a ground cover ratio of 6.14%. However, in doing so, the
Applicants are proposing to eliminate a raised platform tennis court. This
platform tennis court has 1,754 2:. square feet of ground cover. In turn, the
Applicants are increasing the size of their primary dwelling by benefit of
available ground cover from the removal of the raised platform tennis court.
The Zoning Enforcement Officer suggested that as the size of the primary
dwelling would be increasing - even though the aggregate ground cover would
be reduced - Bylaw Section 139-33.A.(9)(b) prevents the Applicants from
receiving relief. Attorney Dale agreed that relief pursuant to Nantucket Zoning
Bylaw Section 139-33.A.(4) would be more appropriate.
5. Therefore, the Board finds that as all setbacks will be met and the
aggregate ground cover will be reduced from what exists, the Applicants
proposed alteration is not substantially more detrimental to the neighborhood
than the existing nonconformity.
6. Accordingly, by a motion made and duly seconded to GRANT the
requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw
Section 139-33.A.(4) to validate the construction of the primary dwelling,
secondary dwelling, and garage/ studio on the locus as shown on the plan
attached as "Exhibit A," there were five (5) votes in favor and none (0) opposed.
