ADDENDUM "A"
Applicants, Theodore B. Goodnow and Kim M. Goodnow ("Goodnow"), own a pre-
existing, non-conforming cottage and lot located at 35 Massachusetts A venue, Nantucket,
Massachusetts shown on a Plan filed as Plan No. 2009-12 at the Nantucket Registry of Deeds
and also shown as Parcel 6 on Nantucket Assessor's Map 60.3.1 ("Property"). This non-
conforming Property is located in the Residential-2 Zoning District.
The Property is non-conforming as to minimum lot size and minimum frontage, and
minimum front and side yard set back requirements. The Property has an area of 5,080:i:: square
feet. The minimum lot size requirement in the R-2 Zoning District is 20,000 sq. ft. The property
has fifty (50') feet of frontage along Massachusetts Avenue; the minimum frontage requirement
in this District is seventy-five (75.00) feet. The existing cottage on the Property is non-
conforming as to front and side yard set back requirements. The front of the cottage abuts
Massachusetts Avenue; a minimum thirty (30.00') foot front yard set back is required in this R-1
District. The east side of the cottage encroaches onto a "paper road" known as Pennsylvania
A venue by approximately four (4:i::") inches; a minimum ten (10') foot side yard set back is
required in this R-1 Zoning District. The existing garage on the Property is located
approximately six (6":i::) inches from the westerly side lot line; a minimum ten (10') foot set back
is required in this District.
This is a pre-existing non-conforming Property that has been held in separate ownership
from other abutting properties from a time prior to the enactment ofthe Nantucket Zoning By-
Law on July 1, 1972 to date. The current ground cover for all structures on the Property is
1,003:i:: sq. ft. (19.7%). Although the maximum allowable ground cover in the R-2 Zoning
District is 12.5%, this non-conforming property has the benefit of a maximum ground cover ratio
of 12.5% oflot area (635::!:: sq. ft.) or 1,500 sq. ft., whichever area is greater. Accordingly, the
maximum allowable ground cover for this non-conforming Property is 1,500 square feet
pursuant to Section 139-33E2(b) of the By-Law. The Property is also located within a Coastal
Dune approximately 215::!:: feet from Madaket Harbor and 130::!:: feet from the Coastal Beach
along the Atlantic Ocean to the south. The Property is serviced by an on-site well and Goodnow
plans to install a Clivus Composting Toilet Septic System. The Property is subject to the threat of
coastal erosion from the south.
Goodnow proposes to relocate and reconstruct the existing cottage to the northern most
portion of the Property, to add approximately 647::!:: square feet ofliving space to the
reconstructed cottage, and to remove or demolish the existing 242::!:: square foot garage. The new
cottage will have a ground cover of approximately 1 ,039::!:: square feet (20.5%).
The front ofthe cottage will be set back from Massachusetts by 43 '2" feet, at its closest
point, and be located six (6") inches from the westerly side line, just as the existing garage is
sited on the Property. The new cottage will also be sited along the easterly lot line within the
perimeter of the Property, thus curing the existing encroachment of the cottage onto
Pennsylvania Avenue. A small shed will be set back 21 '4" from Massachusetts Avenue.
The proposed relocation and reconstruction of the cottage will not be substantially more
detrimental to the neighborhood than the existing cottage and, in fact, will enhance the
neighborhood. Specifically, Goodnow will greatly reduce the existing front yard set back non-
conformity by pulling back the cottage approximately forty-three (43::!::') feet from Massachusetts
Avenue, will eliminate the existing encroachment of the cottage onto Pennsylvania Avenue, will
construct an open timber pile foundation for the cottage about the existing flood plain, and will
install a state-of-art compo sting toilet septic system for the new cottage. Further, the plans for the
project have been approved by the Nantucket Historic District Commission (Certificate of
Appropriateness No. 53411). This project will protect the Property from coastal erosion and
protect the wetland resource areas and ground water table on and under the Property.
For these reasons, Goodnow asks the Board of Appeals to grant them a Special Permit.

My clients seek a Special Permit under Section 139-33A to allow them to
relocate and reconstruct a cottage on their pre-existing, non-conforming lot in
Madaket. All of the existing structures on the Property pre-date the enactment of
the Nantucket Zoning By-Law on July 1, 1972" My clients intend to relocate and
reconstruct their cottage on the north side of their Property to mitigate the threat
of coastal erosion from the south, to comply with existing wetlands regulations, to
reduce existing zoning non-conformities, and to upgrade the failed septic system
on the Property. Currently, the Property is non-conforming as to lot size, frontage,
front yard and side yard setback requirements.
Please mark this matter for hearing before the Nantucket Board of Appeals

1" At a public hearing of the Nantucket Zoning Board of Appeals on
Thursday, April 9, 2009, at 1:00 P"M., at 2 Fairgrounds Road, Nantucket,
Massachusetts, the Board made the following Decision on the Application in
Zoning Board of Appeals File No" 014-09 of Theodore B. Goodnow and Kim M.
Goodnow, of 32 Whitaker Lane, Princeton, MA 01541,
2" Applicants are requesting Special Permit relief pursuant to Nantucket
Zoning Bylaw Section 139-33.A.(4) (alteration of pre-existing, nonconforming
structures) to relocate and reconstruct the cottage on a pre-existing,
nonconforming lot. The Applicants propose to add approximately 6472=. of living
space to the reconstructed cottage and to remove or demolish the existing 2422=.
square foot garage, The Applicants propose to reduce the existing front yard
setback nonconformity and eliminate the existing encroachment onto
Pennsylvania Avenue, The site is located at 35 Massachusetts Avenue, is shown
on Nantucket Tax Assessor's Map 60.3"1 as Parcel 6, is shown on Plan File No"
2009-12, and is recorded at the Nantucket County Registry of Deeds in Book
1104, Page 142" The site is zoned Residential- 20"
3. Our Decision is based upon the Application and accompanying
materials, representations and testimony received at our public hearing" The
Planning Board made no recommendation finding that the Application did not
present any issues of planning concern" No abutter comment was received either
in favor of or against the Application"
4" Attorney Kevin Dale represented the Applicants at the hearing.
Attorney Dale explained that the Property is nonconforming as to minimum lot
size, minimum frontage, and minimum front and side yard setback
requirements" The Property is undersized, having 5,0802=. square feet in a zoning
district that requires a minimum lot size of 20,000 square feet" The Property has
fifty (50) feet of frontage along Massachusetts A venue, in a zoning district that
requires a minimum of seventy-five (75) feet of frontage" The front of the cottage
is abutting Massachusetts Avenue in a zoning district that requires a thirty (30)
foot front yard setback. The east side of the cottage encroaches onto a paper road
known as Pennsylvania Avenue by approximately four (4) inches in a zoning
district that requires a side yard setback of ten (10) feet. The existing garage is
located approximately six (6) inches from the westerly side yard property line in
a zoning district that requires a ten (10) foot side yard setback.
The Applicants now propose to relocate and reconstruct the existing
cottage to the northernmost portion of the Property, add approximately 6472=.
square feet of living space to the reconstructed cottage, and to remove or
demolish the existing 242 .:!=. square foot garage" The new cottage will have
approximately 1,039 .:!=. square feet (the Applicants are allowed to have 1,500
square feet of ground cover pursuant to Nantucket Zoning Bylaw Section 139-
33"E"(2)(b)).
The front of the cottage will be set back from Massachusetts A venue
approximately forty-three feet, six inches (43'6")" The new cottage will also be
sited along the easterly side lot line within the perimeter of the Property" A
small shed will be setback twenty-one feet (21') from Massachusetts Avenue"
5. Therefore, the Board finds that the proposed alteration of the pre-
existing, nonconforming structure is not substantially more detrimental to the
neighborhood than the existing nonconformity,
6, Accordingly, by a motion made and duly seconded to GRANT the
requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw
Section 139-33"A"(4) to alter the pre-existing, nonconforming structures on the
property as shown on the plan entitled "Existing & Proposed Conditions in
Nantucket, MA," prepared by Bracken Engineering, Inc., dated July 10, 2008,
revised June 19, 2009, attached as Exhibit A, with the condition that the
Applicants reduce the width of the structure by one (1) foot on both side for an
aggregate two (2) foot reduction, there were five (5) votes in favor and none (0)
