DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, April 9, 2009, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of Mark A. Lombardi,
Trustee of LLD Nominee Trust, clo Reade, Gullicksen, Hanley &
Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts
02584, File No, 10-09:
2. Applicant is requesting Special Permit relief pursuant
to Nantucket Zoning Bylaw Section 139-33.A(4) (alteration of pre-
existing, nonconforming uses) to change the use of a pre-
existing, nonconforming garage structure to a cabana. The
existing structure is approximately 3 feet from the side yard
setback in a zoning district that requires a 10 foot side yard
setback, The site is located at 8 Madaket Road, is shown on
Nantucket Tax Assessor's Map 41 as Parcel 594, and is recorded at
the Nantucket Country Registry of Deeds in Book 1065 as Parcel
312 and Book 1172, Page 57, The site is zoned Residential - 20,
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received from the Applicant and his attorney at our public
hearing, The Planning Board found the matter to be not of
planning concern, There was no opposition presented at the
public hearing.
4. Applicant has constructed a swimming pool upon the
premises, and wishes to convert an old garage, adjacent to the
pool, for use as a cabana type pool house in the summer, and
vehicle garaging in the off-season. There will be a seating area
and sanitation facilities with a showerlsauna, and a storage area
in the structure. The existing structure has been in its
current location, approximately three feet from the side yard
line with Winn Street since at least 1971, and is a pre-existing
nonconforming structure, Pursuant to the provisions of the
zoning by-law, the change of use of a nonconforming structure
requires special permit zoning relief.
5. The Board finds that the proposed pool houselgarage use
in the nonconforming structure will not be substantially more
detrimental to the neighborhood than the existing garage use. By
a UNANIMOUS (5 - 0) vote, the Board votes to grant the special
permit relief requested to change the use of the structure to a
pool house/garage.
6, The foregoing relief 1S subject to the following
condition:
(a) No wet bar shall be installed in the structure.
