grant enforcement powers to the Town of Nantucket.

be permitted in the RC District and riot RC-2.

(12) In the RCDT District only, up to four residential apartments containing a
maximum of two bedrooms per apartment located on the second or third floor
based upon the following density calculation:

the subject lot. A maximum of four
NHNC apartments are allowed on any
lot.

the subject lot. A maximum of two

(a) Such apartment, if built, shall be the only dwelling unites) on the lot.
(b) Density calculations shall be cumulative so that a 2,500 square foot area lot
would allow up to two NHNC units or one non-NHNC unit. A 3,750 square
foot area lot would allow one NHNC apartments and one non-NHCN
apartment. A 5,000 square foot area lot would allow four NHNC or two
non-NHCN apartments or a combination thereof.
B. Exceptions. The Board of Appeals may grant a special permit to allow the following
uses:
(1) Taverns and bars (which may also be permitted as accessory to a conforming
restaurant use).

(2) The following commercial or municipal uses, provided that the Board of Appeals
shall specifically find, in addition to the other requirements of this chapter as to the
granting of a special permit, that the use will not inherently be in violation of
9 139-7E(4):
(a) Light manufacturing.
(b) Storage and warehousing, including properly screened open storage of goods
and materials.
(c) Fabrication and assembly of component parts for off-site construction or use.
(d) Petrochemical storage and transfer facilities in properly constructed
packaging containers.

(e) Public utility production and distribution facilities.
(f) Printing and publishing.
(g) Garages for storage, repaIr, washing, painting or other servicing of motor
vehicles.
(h) Public transportation facilities.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals on
Thursday, May 14, 2009 and Thursday, June 11, 2009, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the following
Decision on the Application in Zoning Board of Appeals File No. 007-09 of
Muro Ferreira, c/o Vaughan, Dale, Hunter, Stetina, and Beaudette, P.C,
PO Box 659, Nantucket, MA 02554.
2. Applicant requests a Special Permit pursuant to Nantucket Zoning
Bylaw Section 139-9 (commercial uses) to allow the rental and sale of motor
vehicles. The site is located at 47 Nobadeer Farm Road, is shown on Nantucket
Tax Assessor's Map 69 as Parcel 102, is shown on Land Court Plan 16514-31 as
Lot 577, and is registered at the Nantucket County Registry of Deeds as
Certificate of Title No. 22238. The site is zoned Residential Commercial- 2.
3. Our Decision is based upon the Application and accompanying
materials, representations and testimony received at our public hearing. The
Planning Board recommended not granting the Special Permit as the use is far
too intensive for the proposed location. No abutter comment was receiving in
favor or opposed to the Application.
4. At the hearing, the Applicant was represented by his agents and counsel.
Applicant is requesting a Special Permit in order to allow the rental and sale of
motor vehicles (including mopeds) on the premises. The Applicant's agents
stated that despite the intensive use, desirable relief may be granted via Special
Permit. The Applicant's agents and counsel acknowledged that the Planning
Board has made a negative recommendation on this application. The planning
board recommendation is as follows: "The Applicant is proposing motor vehicle
sales, including automobiles and mopeds, at the corner of Nobadeer Farm Road
and Hanabea Lane. The site is approximately 7,456 square feet and it currently
contains a duplex, which will remain on the site. There are two (2) legal pre-
existing nonconformities on the site (side yard setback and parking) and one
setback encroachment that has not been permitted (propane tanks). Access to the
property is through a common driveway which is shared with the property to
the south and to staff's knowledge, the property does not have legal access to
Hanabea Lane. No screening has been proposed and the application does not
include any information regarding employees, an off-site office, number of
bedrooms in the existing duplex, proposed hours of operation, or other details
necessary for a complete application. However, based on the limited amount of
information provided, it is the opinion of the Planning Board that the proposal is
much too intense for this site and that the only means of access to the parking
area is inadequate."
The Applicant's agents explained that the balance of the existing unit will not be
used, as there are only two bedrooms. The Applicant's agent also stated that
there would be privet screening and the Applicant is aware that they are located
within the Wellhead Recharge District and are therefore limited to what they can
and cannot do with their business. The hours of operation were an issue for the
Board and it was agreed that limiting these hours would be a fair compromise
and a way in which to regulate the intensity. The Board suggested that the
privet should be a minimum of five (5) feet when it goes in the ground and there
should only be six (6) cars and six (6) mopeds on site.
5. Therefore, based on the information presented by Applicant's
agents and counsel, the Board found that the proposed commercial use is in
harmony with the general purpose and intent of the Zoning Bylaw.
6. Accordingly, by a motion made and duly seconded to GRANT the
requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw
Section 139-7 (which replaced 139-9) to allow for the rental and sale of motor
vehicles on the premises there were five (5) votes in favor and none (0) opposed
upon the following conditions:
a) One half of the duplex will be used exclusively as office and
not a dwelling. The office would be approximately 100-150
square feet in size and the balance of the apartment will not
be used as an apartment or in support of the special
permitted use;
b) The other side of the building will continue to be used as a
dwelling unit and it has two bedrooms; as the other

dwelling is proposed to be an office there will be only two
bedrooms occupied on the premises;
c) The portion of the property proposed to be used as parking
for the cars and mopeds will be screened with privet and
shall be a minimum of five (5) feet when it goes in the
ground;
d) The applicant will limit the number of automobiles and
mopeds on site to six (6) of each - excluding parking;
e) There will be no servicing or washing of the mopeds and
cars on the premises;
f) All vehicles will be sold and not rented;
g) Hours of operation will be 10:00 AM to 4:00PM Monday
through Saturday, with no sales work on Sunday;
h) No more than one employee will be working at peak shift;
i) Meeting with buyers will be by " Appointment Only"; and,
j) Applicant will correct the location of the propane tanks as a
condition of approval.
7. In a separate motion made and duly seconded, the Board voted to
approve the site plan entitled "Plot Plan to Accompany ZBA Application"
prepared by Blackwell and Associates, Inc., dated February II, 2009, and
attached hereto as "Exhibit A" there were five (5) votes in favor and none (0)
opposed.
