Dear Mr. Church:
Attached herewith please find a completed As-Built Plot Plan for the above address.
Please note that the existing garage as constructed is in non-conformance with the side
yard setback requirements of the SR-2 Zoning District. Research by our office has
discovered the following:
The garage was constructed in it's current location based on a survey conducted
by John Shugrue, Inc. in May of2006. A review of Mr. Shugrue's files reveals
the garage location as staked was based on incorrect interpretations of the lot lines
depicted on the record plan for the subject parcel (plan entitled "Land of F.D.
Hubachek, Jr., Tr." Dated March 12, 1984 by Josiah S. Barrett) plan filed as Plan
No. 22, Page 101. The Barrett plan contains scrivenors errors that were not
reconciled correctly by Mr. Shugrue. Both field survey and office computations
conducted by NSLLC have verified this conclusion.
It is our opinion that a request for a Special Permit pursuant to Town of Nantucket
Zoning Regulation Section 139-l6C.(2) (copy enclosed) is the best method to rectify this
situation.

(b) The total frontage of all lots shall meet or exceed the total frontage
requirements of S 139-16A above.
(c) Each lot shall have a regularity factor of 0.55 or more as required by
Subsection D below.
(d) Notice of the reduction of frontage for any lot under this S 139-16B(3) shall
have been recorded or registered as an encumbrance upon the record title for
each lot considered in making any computation under this section
concurrently with the recording or registration of the plan which created such
lot with reduced frontage or prior to conveyance or building upon any
individual lot shown upon such plan.
C. Exceptions for yards. [See S 139-33E(3) below.] [Amended 5-5-1992 A TM by Art. 36,
AG approval 8-3-1992]
(1) The Board of Appeals may grant a special permit to reduce the ten-foot side and
rear lot setback distance in Districts R-lO and R-2 from 10 feet to five feet.
(2) The Board of Appeals may grant a special permit to validate unintentional setback
intrusions not greater than five feet into a required yard and not closer than four
feet from a lot line, provided that it shall first fmd that the burden of correcting the
intrusion substantially 9utweighs any benefit to an abutter of eliminating the
intrusion and, if the intruding Structure was so sited after 1990, the siting of the
structure was reasonably based upon a licensed survey. [Amended 4-12-2004
ATM by Art. 40, AG approval 9-3-2004]
D. Regularity formula.
(1) The regularity factor of any lot shall not be less than 0.55. The regularity factor
shall be determined by the formula:
r = 16A/p2 where
r = regularity factor
A = land area in square feet
p = perimeter in feet
(2) That part of the lot area in excess of the required lot area may be excluded from
the regularity formula in determining the regularity factor. The perimeter
containing the excess area shall not include the required frontage.
(3) The regularity formula shall not apply to lots recorded or endorsed prior to April
IS, 1980.
E. Open area.
(1) A lot containing a commercial building, structure or use shall have a minimum of
20% of the land as open area free from impervious surfaces.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals on
Thursday, February 12, 2009, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket,
Massachusetts, the Board made the following Decision on the Application in
Zoning Board of Appeals File No. 005-09 of Sors Bona, LLC, of 281 Claremont
Road, Bernardsville, NJ, 07924.
2. Applicant is requesting Special Permit relief pursuant to Nantucket
Zoning Bylaw Section 139-16.C(2) (unintentional setback intrusion) to validate
the siting of the existing garage. The garage is sited as close as 9.1 feet from the
side yard lot line in a zoning district that requires a 10 foot side yard setback.
The site is located at 48 Main Street, Siasconset, is shown on Nantucket Tax
Assessor's Map 73 as Parcel 12.1, is shown in Plan Book 539, Page 251, and is
recorded at the Nantucket County Registry of Deeds in Book 975, Page 290. The
site is zoned 'Sconset Residential - 20.
3. Our Decision is based upon the Application and accompanying
materials, representations and testimony received at our public hearing. The
Planning Board made no recommendation finding that the Application did not
present any issues of planning concern. No abutter comment was received either
in favor of or against the Application.
4. The Applicant was represented by Ms. Jenn Iller. Ms. Iller
informed the Board that the Applicant is requesting a Special Permit pursuant to
Nantucket Zoning Bylaw Section 139-16.C(2) to validate the siting of an existing
garage. The garage is sited as close as 9.1 feet from the side yard lot line in a
zoning district that requires a 10 foot side yard setback. The garage was
constructed in its current location based on a survey conducted by John Shugrue,
Inc. in May, 2006.
A review of Mr. Shugrue's files reveals the garage location as staked was based
on incorrect interpretations of the lot lines depicted on the record plan for the
subject parcel. The original plan contains scriveners errors that were not
reconciled correctly by Mr. Shugrue. Nantucket Surveyors, LLC noticed this and
conducted both field surveys and office computations to verify this conclusion.
5. Therefore, the Board finds that the burden of correcting the
intrusion substantially outweighs any benefit to an abutter of eliminating the
intrusion, and that the intrusion occurred even though the Applicant relied on a
survey prepared by a licensed survey firm. The Board also finds that the
issuance of a special permit to validate the siting of the garage under these
circumstances is in harmony with the general purpose and intent of the Zoning
By-law.
8. Accordingly, by a motion made and duly seconded to GRANT the
requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw
Section 139-16(C)(2) to validate the siting of the garage as shown on the plan
attached as Exhibit A, there were five (5) votes in favor and none opposed.
