State below or attach a separate addendum of specific special permits or variance relief applying for:
The applicant requests a Special Permit under Nantucket Zoning By-
law ~139-16.C, to reduce the (northeasterly) rear yard setback
from ten feet to five feet, in order to validate the existing rear
yard setback of her single-family dwelling, which has rear stairs
which extend to a point about 7. 9 feet from the rear lot line.
These stairs have been in existence since the dwelling was
constructed in 1991, and accordingly, even though constructed by a
prior owner in violation of the rear yard setback requirement, the
violation is no longer enforceable under M.G.L., c. 40A, ~6, and
By-law ~139-25.C(2) and (3). The rear wall of the dwelling lies
more than ten feet from the lot line, and the locus is otherwise
in compliance with all zoning requirements.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, February 12, 2009, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of CYNTHIA L. PHILLIPS, as
Trustee of Pond House Nominee Trust, c/o Reade, Gullicksen,
Hanley & Gifford, LLP, Post Office Box 2669, Nantucket,
Massachusetts 02584, File No. 004-09:
2. The applicant is requesting relief by Special Permit
under Nantucket Zoning By-law ~139-16.C. (1), to reduce the rear
yard setback from ten feet to five feet, in order to validate the
existing stairs that extend to a point about 7.9 feet from the
rear lot line. Locus is situated at 11 Polliwog Pond Road, shown
on Assessor's Map 55 as Parcel 422.6, is shown upon plan recorded
with Nantucket Deeds in Plan Book 20, Page 55, as Lot 6, and is
situated in a Residential-l0 zoning district.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. Except for the presentation by the applicant's
legal representative, there was no support nor opposition
presented at the public hearing. A letter from a neighbor
requested that relief be limited to validating the location of
the existing improvements, rather than generally reducing the
setback to five feet.
4. As presented by the applicant's counsel, the rear stairs
of the dwelling upon locus were constructed by a prior owner in
1991, and are about 7.9 feet from the rear lot line; an affidavit
from the builder was presented in support of this history.
Minimum rear yard setback in this district is, and was at the
time of construction, ten feet. However, By-law ~139-16.C. (1)
empowers the Board of Appeals to reduce side and rear yard
setbacks in this district to five feet, by issuance of a Special
Permit. Although the steps have been in existence for over ten
years and therefore the violation is protected against
enforcement by M.G. L. c. 40A, ~6, the applicants seek to
regularize the situation through the issuance of Special Permit

relief. The rear wall of the dwelling lies more than ten feet
from the rear lot line. Condi tions upon locus are shown upon a
plan by Earle & Sullivan, Inc., dated December 10, 2008, a copy
of which is attached hereto as Exhibit A. (The "shower
enclosure" shown wi thin the setback area was explained by the
applicant's counsel as constituting a fence, thus exempt from
setback requirements.)
5. As mentioned above, a neighbor was concerned that the
requested relief would allow further construction as close as
five feet to the rear lot line, and the same concern was
expressed by members of the Board of Appeals. Counsel for the
applicant explained that there is no intention to construct any
further structures or additions closer than ten feet to the rear
lot line; the reason the applicants requested reduction in the
setback to five feet is that this is the express relief set forth
in the By-law. He suggested that this should be handled by
limiting the relief to the validation of the existing structure,
wi th a condition that no additional construction would occur
within ten feet of the rear lot line without further relief from
the Board of Appeals.
6. Upon these facts, the Board of Appeals, by unanimous
vote, made the finding that the issuance of a Special Permit to
reduce the rear yard setback from ten feet to five feet pursuant
to By-law S:139-16.C. (1), if conditioned as herein set forth,
would be in harmony with the general purpose and intent of the
By-law, and by the same unanimous vote, granted the requested
relief by Special Permit under S:139-16.C. (1), to validate the
existing structure, subj ect to the condition that no further
construction of structures, nor additions to the existing
structure, shall take place within ten feet of the rear lot line
without the issuance of further relief by the Board of Appeals.
