We are applying for setback relief for a small shed on our property. In 2006 we did several
construction projects at our property at #12 Toms Way. We constructed a second dwelling,
covered our porch, re-Iandscaped everything and also intended to build a small shed.
While we were on vacation, our builder constructed the shed rather than working on the
second dwelling. Further, he built it on our western property line. Knowing the shed would
have to be moved, we continued with the other projects with the intent of having our
landscaper move the shed when he did the landscaping.
The landscaper did move the shed, but unfortunately he only moved it 4' 7" rather than 5'.
As a result, the shed is presently still 5" into the setback.
After moving the shed, the landscaper installed an irrigation system, a slate and brick patio
and other plants that make it impossible to move the shed without significantly damaging
these items.
As we have made a good faith effort to move the shed once, we are hoping the ZBA will
grant us the 5" setback intrusion so as to save us considerable expense to rectify the problem.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals on
Thursday, February 12, 2009, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket,
Massachusetts, the Board made the following Decision on the Application in
Zoning Board of Appeals File No. 003-09 of Robert and Margaret Ruley, of PO
Box 703, Nantucket, MA 02554.
2. Applicant is requesting Special Permit relief pursuant to Nantucket
Zoning Bylaw Section 139-16.C(2) (unintentional setback intrusion) in order to
validate the location of a shed located 4.5 feet from the rear lot line in a zoning
district that requires a five (5) foot rear yard setback. The site is located at 12
Toms Way, is shown on Nantucket Tax Assessor's Map 67 as Parcel 47, is shown
in Book 18, Page 28 as Lot 6, and is recorded at the Nantucket County Registry of
Deeds in Book 1070, Page 226. The site is zoned Residential Commercial- 2.
3. Our Decision is based upon the Application and accompanying
materials, representations and testimony received at our public hearing. The
Planning Board made no recommendation finding that the Application did not
present any issues of planning concern. No abutter comment was received either
in favor of or against the Application.
4. The Applicant represented himself and stated that unbeknownst to
him, his builder constructed the shed in question on the westerly property line.
The Applicant, upon realizing that the shed would have to be moved as it was in
the westerly setback, proceeded with the other renovations to his locus. During
these renovations, a landscaper relocated the shed. At the bequest of the
Applicant, the shed was to be moved out of the setback. However, the Applicant
stated that the landscaper relocated the shed as close as 4'7" from the westerly
side yard property line in a zoning district that requires a five (5) foot side yard
setback. Upon moving the shed, the landscaper installed an irrigation system, a
slate and brick patio, and other plantings. Moving the shed would significantly
damage these items.
5. Therefore, the Board finds that the burden of correcting the
intrusion substantially outweighs any benefit to an abutter of eliminating the
intrusion, and that the intrusion occurred even though the Applicant relied on a
survey prepared by a licensed survey firm. The Board also finds that the
issuance of a special permit to validate the siting of the shed under these
circumstances is in harmony with the general purpose and intent of the Zoning
By-law.
8. Accordingly, by a motion made and duly seconded to GRANT the
requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw
Section 139-16(C)(2) to validate the siting of the shed as shown on the plan
attached as Exhibit A, there were five (5) votes in favor and none opposed.
