TOWN OF NANTUCKET ZONING BOARD OF APPEALS 2 FAIRGROUNDS ROAD NANTUCKET, MA 02554 Assessor's Map: 69 Parcel: 1 Plan File 52A 81 Milestone Road Book 565, Page 17 At a Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS held at 1:00 p.m., Thursday, January 15, 2009, in the Garage Area meeting space, 2 Fairgrounds Road, Nantucket, Massachusetts 02554 on the Application of the Nantucket Land Bank, of 22 Broad Street, Nantucket, MA 02554, for itself as owner and the Nantucket Park and Recreation Department, of 2 Bathing Beach Road, Nantucket, MA 02554, Board of Appeals File No. 085- 08, the Board made the following decision: 1. The Applicant (Nantucket Park and Recreation Department) is seeking SPECIAL PERMIT relief pursuant to Nantucket Zoning By-law Section 139-19 (screening of parking areas). Applicant is seeking relief from certain provisions related to the screening of a proposed new parking area that would be ancillary to the proposed new Town playing fields at the Nobadeer Farm Road Athletic Fields site. The site is located at 81 Milestone Road, is shown on Nantucket Tax Assessor's Map 69 as Parcell, and is recorded at the Nantucket County Registry of Deeds in Book 565, Page 17. The site is zoned Limited Use General-3. 2. The Decision is based upon the Application and the materials submitted with it and the testimony and evidence presented at the Public Hearing. The Planning Board made no recommendation as the matter did not present any issues of planning concern. There were no letters on file in favor of or in opposition to the Application. There were abutters present at the Hearing who spoke against the application stating that the proposed playing fields, an issue not before the Board of Appeals at that time, would have a negative impact on the surrounding residential area. Abutters asked that there be as much screening as possible planted and maintained, including on the interior of the lot surrounding the parking area. Other interested parties expressed concern about the project in general about the Land Bank's elimination of open space in favor of municipal playing fields. 3. Applicant stated that application was made to the Board of Appeals at the request of the Zoning Enforcement Officer ("ZEO") as in the opinion of the ZEO the proposed parking area on the preliminary site plan did not provide adequate screening under the provisions of Zoning By- law Section 139-19 for parking areas of 20 or more spaces. In this case, approximately 60 parking spaces were proposed to be created in conjunction with the construction of one of a possible four separate playing fields. The ZEO noted at the Public Hearing that the screening for the parking area complied with the provisions contained in Nantucket Zoning By-law Section 139-19 A related to parking areas with five or more parking spaces, which reads: Parking areas with five or more parking spaces on a lot shall be effectively screened on each side adjoining or fronting on any street and/or abutting property by a wall, fence or densely planted compact hedge not less than three feet nor more than eight feet in height, except where the closest point of such parking area is at least 75 feet from the nearest abutting property line or street. However, the ZEO noted that pursuant to Nantucket Zoning By-law Section 139-19.B, the proposed parking area did not comply as specified on the preliminary plan for parking areas that contained 20 or more parking spaces. Said Section reads in part; Parking areas shall be bordered by a five-foot-wide planting strip buffer with at least one tree per eight parking spaces. ..Trees are to be of four-inch trunk diameter or larger, with not less than 26 square feet of unpaved soil area per tree. Though no construction had taken place at the site to date, and thus no violation of the screening provisions had taken place, the ZEO stated nevertheless that the Applicant's site plan did not indicate that the necessary screening pursuant to Nantucket Zoning Bylaw Section 139-19.B would be provided. Applicant stated that it was a preliminary plan and did not contain that level of specificity as yet. The Applicant stated that the site provided adequate screening because of the existing dense vegetation that would be maintained on the multi-acre site and the siting of the parking area to the interior of the site. However, the ZEO stated that the Applicant should seek relief from the Board of Appeals prior to commencement of the project or revise the site plan to indicate compliance prior to a Building Permit being issued. Applicant stated that there was sufficient perimeter screening and requested a waiver of the interior screening requirements of having to provide one tree per eight parking spaces as the site contained several acres of trees. 4. Therefore, based upon the foregoing, the Board finds that the Applicant has sufficient area to meet the requirements of Zoning By-law Section 139-19B. The Board further finds that there were insufficient mitigating factors upon which to grant relief by Special Permit from the screening requirements. 5. Accordingly, at the hearing on January 15, 2009, a motion to approve the requested Special Permit relief and waive the screening requirements pursuant to Nantucket Zoning By-law Section 139-19.B. was duly made and seconded. The Board voted one in favor (Koseatac) and four opposed (Waine, Toole, Botticelli, Poor) to the granting of relief. Therefore, the request for Special Permit relief is hereby DENIED.
