BOARD OF PUBLIC WORKS
: Minutes of the Meeting of October 2, 1991 at 7:30 PM. The meeting
! took place in the Selectmen's Hearing Room, Town Building,
Nantucket, MA 02554. Members of the Board present were: Diane
Coombs, Wayne Holmes, Nancy Sevrens, Carl Borchert and Bernard
Grossman. Chairman Coombs called the meeting to order at 8:12 PM
after the meeting of the County Commissioners.
I Appeal of Biodeqradable Packaqinq Review Committee's Denial of
Request for Extension of Exemption From Regulation: Matthew and
Sheila Fee/Somethinq Natural. Due to possible conflict of interest
Chairman Coombs stepped down; Mr. Borchert became chair. David
Moretti, attorney for Matthew and Sheila Fee, spoke to the
constitutional problems which he believed were inherent in the by-
law and produced evidence that other vendors are selling products
wrapped in plastic. Mr. Fee spoke on what he felt was his good
faith effort to find a replacement product and on the problems he
had experienced with products other than plastic which had prompted
him to request an extension of his exemption. Mr. Bruce Perry of
the Packaging Review Committee explained the Committee's reasons
for not granting the exemption for another year didn't sway the
committee and questioned whether the sandwiches
were unique enough to grant the exemption. Mr. Henry Fee and
Deborah Deeley spoke in favor of the exemption. Discussion
followed on the intent of the by-law. Mr. Borchert stated that he
did not see that Something Natural had more extenuating
circumstances than any other establishment. Mr. Grossman moved to
extend the exemption one year, pending further study on an
applicable substitute; seconded by Mr. Holmes. So voted. Mr.
Borchert abstained from the vote.
There being no further business before the Board, the meeting was
unanimously adjourned at 8:53 PM.
