New Business:
1. 36 Sesechacha Pond (0021/0076&0077) Variance Request:
Health Officer Ray recommends granting of the variance with the
stipulation that the maximum daily flow not exceed 1600 gpd.
Seconded. Approved, variance granted.
2. Human Habitation Code adoption:
Health Officer Ray seeks preliminary approval to adopt the State
Human Habitation Code (l05CMR4-4l9) as a local regulation for the
purpose of ENFORCEMENT. This would allow the Town of Nantucket to
institute a "non-criminal" fining system, that would be used year round.
C. Bartlett asked how the fine would be payable by the "owner" and
not the tenant? R. Ray states that the code specifies that the fine is put to the
owner of the property and not any other person.
Chairman Desrocher commends R. Rayon his actions to attempt a way
to correct the habitation concerns faced each summer.
H.O. Ray states:--over crowding is defmed by the square footage of a
dwelling. A problem arises with the septic system limitations for each
specific dwelling. After thirty days, the unpaid fine, of $400. p/day, imposed
on a property owner becomes a criminal offense.
Twenty one days is needed to post notification for a public hearing and the
date is set for April 24, 1996. This is seconded and approved.
3. Other Business :
R. Ray wishes to remind the public that Spring Cleaning should be
perform in a manner which contains any hazardous materials; auto/truck
\ .
cleaning (oil, grease, gasoline) should be done where the waste water will not
go directly into the ground; and power washing of windows or shingles on
houses with lead paint present--the waste water must not be allowed to run
into the ground without collection of hazardous material.
