HomeMy WebLinkAbout1993-05-26 II BOARD OF HEALTH Minutes of the Meeting of 26 May 1993 at 7:30 PM. The Meeting took place in the Town & County Building, Nantucket, MA 02554. Members of the Board present were: Wayne Holmes, Arthur Desrocher, Cheryl Bartlett, and Timothy Madden. Chairman Holmes called the meeting to order at 7:30 PM. Approval of Minutes of28 April 1993 at 7:30 PM: 31 March 1993 at 7:30 PM. Mr. Desrocher moved approval of the minutes of April 28, 1993; seconded by Ms. Bartlett. Mr. Desrocher moved approval of the minutes of April 28, 1993; seconded by Mr. Madden. So voted. Public Hearing to Consider Whether to Establish a Fee for Temporary Food Service Establishments. Chairman Holmes noted that this matter was continued from the meeting of January 27,1993 and the issue is whether to uphold the recommendation of the Health Officer and the Board of Health Advisory Committee to establish a $10.00 fee for temporary food service establishments. Chairman Holmes opened the hearing and Mr. Madden spoke against the fee. Health Officer Richard Ray spoke in favor of a $10.00 fee. Mr. Madden inquired who would be subject to this fee and Health Officer Ray explained that individuals who prepare food for large gatherings on an irregular basis would be subject to the fee. Mr. Desrocher inquired whether "covered dish" dinners popular with halls and churches would be subjected to the fee and Officer Ray responded no, stating that churches and halls are properly licensed to sponsor this type of event. Ms. Bartlett inquired whether this charge will be a one time only fee and Mr. Ray affirmed that each time a temporary food service establishment wishes to hold a gathering a fee will be required. Board of Health Advisory Member Curtis Barnes spoke in favor of the fee. Chairman Holmes closed the hearing and Ms. Bartlett moved to approve a $10.00 fee for temporary food service establishments. The motion died for lack of a second. Mr. Madden moved to limit this fee to a one time only basis; seconded by Mr. Desrocher. Ms. Bartlert amended the motion so that the temporary license and fee must be obtained on a yearly basis. The amendment failed for lack of a second. The original motion to require a one time fee only failed as Chairman Holmes and Ms. Bartlett were opposed and Mr. Madden and Mr. Desrocher were in favor. Mr. Desrocher moved to continue this matter until the June 30, 1993 Board of Health when a full board will be present; seconded by Ms. Bartlett. So voted. Mr. Madden was opposed. 2 Lot Subdivision of Property on Brewster Road. Mr. Desrocher moved to adopt the recommendation of the Health Officer concerning a two lot subdivision fronting on Brewster Road, owned by Carol Carpenter that: lot one is acceptable for septic system design and may contain one additional dwelling; lot 2 is acceptable for septic system design for a single dwelling, and to forward the recommendation to the Planning Board; seconded by Mr. Madden. So voted. 6 Lot Subdivision of Property off Hummock Pond Road. Mr. Desrocher moved to adopt the recommendation of the Health Officer concerning a six lot subdivision off Hummock Pond Road, owned by Henry Bartlett that: Lot 1 is acceptable for the design of a septic system servicing a single dwelling; lots 2 & 3 each contain an existing dwelling and may not accept a second dwelling; lot 4 is acceptable for the construction of a septic system servicing a single dwelling; lots 5 & 6 are not acceptable for septic system design, and to forward the recommendation to the Planning Board; seconded by Mr. Madden. So voted. Variance Request from Section 50.02 Town of Nantucket Regulations Affecting Madaket. Chairman Holmes noted that Francis and June Tomaiolo are requesting a variance to address a failed septic system at their property situated at 45 Starbuck Road. Mr. Desrocher moved approval as recommended subject to the dwelling on the subject lot be limited to four (4) bedrooms, and this provision be recorded with the deed for the property at the Nantucket Registry of Deeds; seconded by Mr. Madden. So voted. Variance Request from Section 50.02 Town of Nantucket Regulations Affecting Madaket. Chairman Holmes noted that Sterling Bank, owner of property situated at 20 Midland A venue is requesting a variance to address a failed septic system. Mr. Desrocher moved approval as recommended by the Health Officer subject to the dwelling on the subject lot be limited to four (4) bedrooms, and this provision be recorded with the deed for the property at the Nantucket Registry of Deeds; seconded by Mr. Madden.
