The Meeting took place in the Selectmen's Hearing Room, Town & County Building, Nantucket, MA 02554. Members of the Board present were: Wayne Holmes, Arthur Desrocher, Carl Borchert, Nancy Sevrens and Timothy Madden. Chairman Holmes called the meeting to order at 7:30 PM. ApJ)roval of Minutes of January 27. 1993 at 7:30 PM. Mr. Desrocher moved approval; seconded by Mr. Madden. So voted. Variance from Board of Health Regulations for Property on Arkansas Road. Madaket for Failed Septic System. Chairman Holmes read a memorandum from Health Officer Richard Ray regarding a variance request needed to repair a failed septic system on property situated at 60 Arkansas Road, owned by Lawrence Garfindel. Chairman Holmes noted that Conservation I Commission Administrator Bruce Perry has also reviewed the request and has made a recommendation regarding the Garfindel variance request. Mr. Desrocher moved approval of the variance request as recommended by the Board of Health Advisory Committee and Health Officer Ray, contingent upon the stipulation set forth in Mr. Ray's memorandum of February 3, 1993 that the dwelling be limited to three bedrooms; and further subject to Mr. Perry's memorandum of February 23, 1993 that the pipe, shown on Mr. Garfindel's Determination of Applicability, be immediately capped; seconded by Mrs. Sevrens. So voted. Variance from 310 CMR 15.00 (State Sanitary Code) for Property at 4 North Gully Road. Siasconset for Relocation of Compromised Septic System. Chairman Holmes read a memorandum from Health Officer Richard Ray regarding a variance request from 310 CMR 15.00 - State Sanitary Code for a relocation of a compromised septic system on property situated at 4 North Gulley Road, owned by Joan Wilson. Chairman Holmes noted that Conservation Commission Administrator Bruce Perry has also reviewed the request and recommended certain stipulations be attached to the variance. Mr. Desrocher moved approval of the variance request as recommended by the Board of Health Advisory Committee and the Health Officer, contingent upon stipulations set forth in Health Officer Ray's memorandum of February 12, 1993; and, further subject to Conservation Commission Administrator Perry's recommendation set forth in his memorandum of February 23, 1993; seconded by Mr. Borchert. So voted. Variance from Board of Health Madaket Regulations and 310 CMR 15.03 (7) for Property at 15 Washington Street. Madaket for Failed Septic System. Chairman Holmes read a memorandum from Health Officer Richard Ray regarding a variance request from both the Regulations Effecting Madaket, and 310 CMR 15 Subsection 15.03 (7), needed to address a failed septic system on property located at 15 Washington Street, owned by Norman Brooks. Mr. Desrocher moved approval of the variance request as recommended by the Board of Health Advisory Committee and Health Officer Ray, contingent upon the stipulations set forth in Mr. Ray's memorandum of February 12, 1993; seconded by Mr. Borchert. Mrs. Sevrens amended the motion so as the wells less than 100 feet from the Brooks's leach facility shall be tested and found to be bacteriologically and chemically safe for consumption, said testing to be done only in August or September. The motion was carried as amended. Variance from Board of Health Madaket Regulations and 310 CMR 15.03(7) for Property on D Street. Madaket for Failed Septic System. Chairman Holmes read a memorandum from Health Officer Richard Ray regarding variance requests from both the Regulations Effecting Madaket, and 310 CMR 15.00 Subsection 15.03 (7), needed to address a failed septic system for property situated at "D" Street, Madaket, owned by the Boston Five Cents Savings Bank. Mr. Desrocher moved approval of the variance request as recommended by the Board of Health Advisory Committee and Health Officer Ray, contingent upon the stipulations set forth in Health Officer Ray's memorandum of February 12, 1993, noting that the testing of said wells be done in August or September; seconded by Mr. Madden. So voted. Request for Hearing to be Scheduled on March 31. 1993 Regarding Issuance of Well Construction Permit UW-2-93. Chairman Holmes read a memorandum from Health Officer Richard Ray requesting a hearing be scheduled for March 31, 1993 for the purpose of considering the issuance of a Private Well Construction Permit. Mr. Desrocher moved approval; seconded by Mrs. Sevrens. So voted. II There being no further business before the Board, the meeting was unanimously adjourned at 7:50 PM.
