HomeMy WebLinkAbout1992-12-16 BOARD OF HEALTH Minutes of the Meeting of 16 December 1992 at 7:30 PM. The meeting took place in the Selectmen's Hearing Room, Town Building, Nantucket, MA 02554. Members of the Board present were: Wayne Holmes, Nancy Sevrens, Carl Borchert, Arthur Desrocher and Timothy Madden. Chairman Holmes called the meeting to order at 7:30 PM. Approval of Minutes of November 18. 1992. Mr. Desrocher moved approval; seconded by Mr. Madden. So voted. Variance Request for Grandfathering of Permit to Operate a Food Establishment at 18 Gardner Street. Chairman Holmes noted that Health Officer Richard Ray's memorandum of December 14, 1992 stated that until such time Roger Schmidt, proprietor of 18 Gardner Street Inn, resolved his zoning problems with the Building Department, the Health Department could not renew Mr. Schmidt's Food Establishment Permit when it expires December 31, 1992. Chairman Holmes further noted that, as a result of Mr. Ray's denial of a Food Establishment Permit, Mr. Schmidt was requesting an exemption from the Board of Health Policy adopted on September 9, 1992. Health Officer Ray's memorandum recommended that the request for exemption be denied because, in Mr. Ray's opinion, to grandfather this establishment would defeat the purpose of the policy. Health Officer Ray addressed the Board and explained that, at the Board of Health Advisory Committee's meeting of December 15, 1992, it was voted to modify the recommendation of the Health Officer and recommend a six (6) month grandfathering period allowing the owner a Food Service Establishment Permit with the ability to serve full meals while effecting compliance with all requirements stipulated by the Building Department. Health Officer Ray stated that he was reversing his recommendation for denial of the exemption and supporting the recommendation of the Board of Health Advisory Committee. Mr. Desrocher moved to approve as recommended; seconded by Mr. Madden. Some discussion followed regarding zoning issues as related to the variance request. The request for grand fathering was denied as Chairman Holmes, Carl Borchert and Nancy Sevrens voted in opposition. Variance Request from Nantucket Health Code for Property Located in Tristram's Landing, Chairman Holmes read a memorandum from the Health Officer regarding a variance request from 310 CMR 15.00 Title 5: Minimum Requirements for the Disposal of Sanitary Sewage, anq from Regulation 50.02: Regulations Effecting Madaket. Health Officer Ray explained that th~ lot is part of a triplex configuration which currently has a failed septic system, compromisin the habitability of the structure. Mr. Desrocher moved approval of the variance request a recommended by Health Officer Ray and the Board of Health Advisory Committee, contingen upon the stipulations set forth in Mr. Ray's memorandum of December 16, 1992; seconded b~ I Mr. Madden. Chairman Holmes read J memorandum from Health Officer Richard Ray regarding a variance request from Regulatiod 50.00: Regulations Effecting Madaket and Regulation 60.00: 40,000 SQ Foot Regulations fo~ property situated at 343 Madaket Road. Mr. Desrocher moved approval of the variance reque~ as recommended by the Board of Health Advisory Committee and Health Officer Ray, contingen upon the stipulations set forth in Mr. Ray's memorandum of December 3, 1992; seconded b Mr. Madden. So voted.
