BOARD OF HEALTH
Minutes of the Meeting of 2 September 1992 at 7:30 PM. The meeting
took place in the Selectmen's Hearing Room, Town Building,
Nantucket, MA 02554. Members of the Board present were: Wayne
Holmes, Nancy Sevrens, Carl Borchert, Arthur Desrocher and Timothy
Madden. Chairman Holmes called the meeting to order at 7:30 PM.

Request Approval of Variance Request to be Forwarded to State
Plumbinq Board. Chairman Holmes noted that this matter was tabled
from the August 19, 1992 meeting at Health Officer Ray's request.
Mrs. Sevrens read a letter from Mr. Ray which was unfavorable to
the petitioner's request that he be granted a variance from the
State Plumbing Board. Mr. Ray was of the opinion that to grant a
variance, for what he felt was a planning oversight, was
inappropriate. Mr. Ray's letter further noted that the State
requires separate facilities for each sex specifying one facility
for each sex and the petitioner must by law be aware of all
pertinent rules and regulations as they apply to the proposed
facilities. Ken Parker, petitioner in this matter, spoke on his
request explaining that he wanted to alter the existing bath into
one large handicap accessible uni-sex bath. Chairman Holmes
inquired as to why he could not comply with the code as the Health
Officer requested. Mr. Parker stated that his restaurant seats 24
and the state requires two bathrooms once the seating exceeds 19.
Mr. Madden stated that he felt Mr. Parker's business was small
enough to warrant only one large uni-sex bathroom. Mr. Borchert
concurred with Mr. Madden and clarifified that the Board of Health
was not granting this variance but rather was only granting
permission for Mr. Parker to apply to the state for a variance.
Mr. Madden moved approval for the Board to send a letter to the
State Plumbing Board recommending approval of Mr. Parker's variance
request: seconded by Mr. Borchert. So voted. Mrs. Sevrens and Mr.
Desrocher were opposed.
There being no further business before the Board, the meeting was
unanimously adjourned at 7:40 PM.
