HomeMy WebLinkAbout1992-11-03 II BOARD OF HEALTH Minutes of the Meeting of 11 March 1992 at 7:30 PM. The meeting took place in the Selectmen's Hearing Room, Town Building, Nantucket, MA 02554. Members of the Board present were: Diane Coombs, Wayne Holmes, Nancy Sevrens, Carl Borchert and Bernard Grossman. Chairman Coombs called the meeting to order at 7:30 PM. Hearing on Appeal of Private Well Construction Permit Approval (Permit #W-8-92) bv Rosemarv Cunninqham. Health Officer Richard Ray explained the situation with respect to Title Five and local Board of Health regulations. Mrs. Sevrens read a letter from the appellant's attorney Robert Shelmerdine. Mr. Ray stated that the area in question is acceptable for septic and well design. Some discussion followed. Chairman Coombs asked if anyone was present to speak for appellant. There was no response. Attorney Arthur Reade stated that he represents the owner of the land in question. Mr. Reade spoke on the legality of the decision to issue a well permit for this property. Chairman Coombs asked if there was anyone else present to speak for defendant. There was no response. Mrs. Sevrens asked if there was any reason why the owner could not move the well. Mr. Reade noted that the well had already been installed. Mr. Borchert stated that he would have no problem upholding the decision to grant the permit. Further discussed ensued. Chairman Coombs then closed the hearing. Mr. Grossman moved to sustain the decision of the Health Officer due to the fact that the well was installed on a viable building lot; seconded by Mr. Grossman. Mrs. Sevrens commented that perhaps the appellant should pay to move the well. Mr. Ray acknowledged Mrs. Sevrens' statement and noted that the well is legally placed. Mr. Holmes asked about the appeal period. Mr. Ray stated that this appeal had been filed on the last day. Mr. Holmes commented that the owners knew they were installing a well during an appeal period. Mr. Ray concurred and noted that that was a routine practice. Some discussion followed. A vote was then taken, with all in favor to uphold the decision of the Health Officer in this matter. So voted. Annual Nomination of Animal Inspector. Mr. Holmes moved approval of the nomination of Mr. Henry Hastings, Animal Control Officer as Animal Inspector; seconded by Mr. Grossman. So voted.
