HomeMy WebLinkAbout1991-07-10 BOARD OF HEALTH Minutes of the Meeting of 10 July 1991 at 7:30 PM. The meeting took place in the Selectmen's Hearing Room, Town Building, Nantucket, MA 02554. Members of the Board present were: Diane Coombs, Wayne Holmes, Nancy Sevrens, and Carl Borchert. Bernard Grossman was absent. Chairman Coombs called the meeting to order at 7:30 PM. Hearinq for State Sanitary Code violation at 68!, Union Street. I Health Officer Richard Ray explained that the violation was for overcrowding. Ms. Ellen Morrissey, owner of the property, was present and explained that she had recently had extensive renovations done to the structure in question which, in her opinion, allowed more room for living space. Ms. Morrissey added that her tenants would be leaving at the end of the month. Mr. Ray noted that the question was not about space in the overall structure, but rather the space contained in the bedrooms. Mr. Holmes asked Ms. Morrissey if she was disputing the violation notice. Ms. Morrissey responded that she was not. Mrs. Sevrens asked Ms. Morrissey if she was proposing that the situation remain as it is until the end of the month when the tenants leave. Ms. Morrissey responded affirmatively. Mr. Borchert asked Mr. Ray what his suggestion was to resolve the situation. Mr. Ray replied that if the occupancy were reduced from six to three, the situation would be resolved. Ms. Morrissey stated that she would be complying with that reduction, at the end of the month and possibly sooner. Mr. Holmes moved to uphold the ruling of the Health Officer that the violation be corrected forthwith, and if such corrections were not forthcoming within the next couple of days, Mr. Ray should seek judicial action. The motion was seconded by Mrs. Sevrens. So voted. Mr. Grossman arrived at 7:45 PM and abstained from the vote. Hearing for Public Nuisance at 121 Madaket Road. Mrs. Sevrens read a letter from Mrs. Linsley Kilvert, owner of the property at 121 Madaket Road at which the placement of a certain manure pile was believed to be a public nuisance by the neighbors, Mr. & Mrs. David Bradt. The letter requested that the hearing be continued until July 24, 1991 so that Mrs. Kilvert could be present at the meeting. Mr. Holmes stated that he would be abstaining from any discussion and vote on this matter. Mrs. Sevrens moved that the matter not be continued as requested; seconded by Mr. Borchert. So voted. Mr. Ray explained that complaints from Mr. & Mrs. Bradt about the placement of the manure pile had been on-going for approximately a year and a half. Mr. Ray noted that the Board could issue an order that the manure pile be placed elsewhere and his letter of July 17, 1991 contains a recommendation that all of the fresh and seasoned manure from the western abutting property line be relocated to the center of the property, to the eastern most boundary. Mrs. Sevrens moved approval of Mr. Ray's recommendation and for the manure pile to be so relocated within five days; seconded by Mr. Borchert. So voted. Other Business. Chairman Coombs noted that several complaints had been received with regard to noise emanating from the structure at 68~ Union Street and that although the Selectmen could not take specific action on noise complaints, such complaints should go to the Police Department. Mr. Jim Nickerson, a neighbor, said that he had informed the police numerous times of noise from the premises and that the problem stops when the police are at the premises but continually recurs when they are gone. Executive Secretary Lee Bourgoin explained that after at least two official complaints, fines could be levied against the owner of the property. Mrs. Margaretta Nettles, a neighbor, spoke on the noise problem also. Mr. Jim Cochran, another neighbor, spoke on the noise problem and added that garbage is another problem at the premises. Ms. Morrissey stated that she planned to move into the premises herself at the end of the month. Chairman Coombs noted that the problem was occurring at present. Mrs. Sevrens commented that the problem is a public nuisance and that Ms. Morrissey was responsible for resolving the situation immediately. Chairman Coombs again advised that any complaints with regard to noise from the premises be directed to the Police Chief. Minutes of the Meeting of July 10, 1991 at 7:30 PM. Page II. Mrs. Sevrens read a letter from the Captain of the vessel "Enterprise" in response to a recent violation notice which had been issued by the Health Officer for discharge of grey water into the harbor. Mr. Ray explained the incident. Some discussion followed with regard to the nature of the violation and whether or not it had been intentional. Mr. Borchert stated that in his opinion Mr. Ray had been correct in his response to the problem and the Enterprise appeared to have been prompt in correcting the problem.
