BOARD OF HEALTH
Minutes of the Meeting of 6 February 1991 at 7: 30 PM. The
meeting took place in the Selectmen's Hearing Room, Town & I
County Building, Nantucket, MA 02554. Members of the Board
present were Chairman Bernard Grossman, Nancy Sevrens, Carl
Borchert and Diane Coombs. Chairman Grossman called the meeting
to order at 7:35 PM.
Approval of Minutes of January 2. 1991 at 7:30 PM. Mrs. Coombs
moved to approve the minutes and to waive the reading; seconded
by Mrs. Sevrens. All in favor. So voted.
Discussion on Water Suppl v in Wauwinet. Mrs. Coombs read a
letter from Mr. George Dallas, who was also present at the
meeting, seeking guidance on how to proceed with permitting for
a private well for certain home owners in Wauwinet. Mr. Dallas
stated that the water supply would be private as it would
provide water only for certain people and the land would be held
by a private corporation composed of those people. Mrs. Sevrens
suggested to Mr. Dallas that he refer to the Department of
Environmental Protection in this matter. Mr. Dallas responded
that he felt that the situation was a local one, and that
resolution of the matter could take months if he had to refer to
the state. Health Officer Richard Ray cited a need for a water
supply in that area and read a letter defining a public water
supply, from Mr. Lawrence Dayian of the DEP. Health Officer Ray
contended that the water supply would be public and must be
filed as such with the DEP. Mr. Ray noted that the Wauwinet Inn
currently serves those people who would be served by the
proposed water supply, as a public water supplier and is so
licensed by DEP. Mr. Borchert stated that the health
implications need to be considered and suggested that Mr. Dallas
either obtain the proper permits from the state, or assist the
Wauwinet Inn in upgrading its water supply system. Mrs. Coombs
inquired as to the Wauwinet Inn's opinion on this matter. Mr.
Russell Cleveland, representing the Wauwinet Inn, stated that
the Inn will continue to supply water to residents currently
being served, as long as possible, but cannot provide deeded
rights to property owners. He also noted that new restrictions
have been imposed by the state making it difficult to continue
this service. The Board took no action on this matter.
variance Reauest from 310 CMR 15.11. Mrs. Coombs read a letter
from the Health Officer recommending that the request be granted
for Edward Harris of Baltimore Street, Madaket. Mrs. Sevrens
moved approval as recommended; seconded by Mrs. Coombs. All in
favor. So voted.
variance Reauest from section 64.03 (A). Mrs. Coombs read a
letter from the Health Officer recommending that the request be
granted for Tina Lewis of Hummock Pond Road. Mr. Borchert moved
approval as recommended; seconded by Mrs. Sevrens. All in favor.
So voted.
New State Bed and Breakfast Requlations. Mr. Ray explained that
the state will now regulate bed and breakfast establishments
which were previously unregulated. Mr. Ray further explained the
applicability of the law and gave a general outline of the
regulations. Mrs. Sevrens asked if the new law would require
more on-site inspections. Mr. Ray responded affirmatively. Mrs.
Sevrens moved to set a policy to provide, in principal, allowing
waivers to bed and breakfast establishments with ten rooms or
more to exempt them from the requirement of a second kitchen if
serving only continental breakfast. This issue must be brought
before the Board in the future for each establishment, since a
future blanket waiver is not legal. Mr. Borchert seconded the
motion. All in favor. So voted.

was unanimously adjourned at 8:20 PM.
