BOARD OF HEALTH
The Minutes of the Meeting of August 16, 1990 at 7:30 PM. The
meeting was held in the Large Group Instruction Room at the
Nantucket High School, Atlantic Avenue, Nantucket, MA 02554. All
members of the Board were present. Chairman Bernard Grossman
called the meeting to order at 7:30 PM.
Public Hearinq to Consider Amendments to Groundwater Protection
Requaltions. Mr. Grossman read a letter of transmittal from Mr.
Kevin Dale, Chairman of the Advisory Committee to Consider
Amendments to the Groundwater Protection Regulations. Mr. Dale
explained the amendments to Section #62.00 on private wells.
Mrs. Sevrens moved adoption of section #62.00 as amended.
Seconded by Mrs. Coombs. All in favor. So voted.
Mr. Dale went on to explain the proposed amendments to section
#63.00 on toxic and hazardous materials. Mrs. Coombs moved
approval of section #63.00 as amended. Seconded by Mr. Borchert.
All in favor. So voted.
Mr. Dale explained the proposed amendments to section #64.00 on
on-site sewage disposal systems. Mr. Borchert moved adoption of
Section #64.00 as amended. Seconded by Mrs. Sevrens. All in
favor. So voted.
Mr. Dale stated that no amendments had been proposed for section
#65.00. Mr. Viera moved adoption of section #65.00. Seconded by
Mrs. Coombs. All in favor. So voted.
Mr. Dale explained the amendments to section #66.00 on the
upgrading of substandard on-site septic systems. Mrs. Sevrens
moved approval of Section #66.00 as amended. Seconded by Mrs.
Coombs. All in favor. So voted.
Mr. Borchert moved to publish the regulations on Thursday,
August 23, 1990, to continue the hearing until 7:30 PM on August
22, 1990 in the Selectmen's Hearing Room, and to make the
regulations subject to additional language clarification by Town
Counsel to ensure that the standards for making the decision are
clear, that due process requirements are clearly inserted and
that the regulations are defensible. Mr. Borchert added that any
such clarifications in language are to be provided to the
Advisory Committee for review at the committee's next meeting,
on August 21, 1990 at 11:00 AM in the Selectmen's Hearing Room;
and, that fiahl approval of the language clarifications will
take place at the continuation of this hearing on August 22,
1990. Seconded by Mrs. Sevrens. All in favor. So voted.
Mr. Dale stated that the committee also had recommended that all
maps relating to the regulations be converted to 1,000 scale and
that the Board of Health appoint a new, on-going advisory
committee. Chairman Grossman responded that these
recommendations should be taken up in the near future.
There being no further business before the Board, the meeting
was unanimously adjourned at 8:50 PM.

APPEAL PROCESS
AMENDMENT TO BOARD OF PUBLIC WORKS REGULATION #72.00,
LANDFILL USER FEE REGULATIONS (AMENDED AUGUST 15, 1990)
The landfill user fee regulations shall consist of
user fee schedule adopted 12/14/88, the revision
schedule adopted 1/17/90 and the Appeal Process
below:

Requests for a reduction in the amount billed will follow the
process shown in the attached flow chart and accompanying forms.
User fees must be paid by the required deadline; any abatement
authorized will later be returned to the applicant.
First, a request received on the ABATEMENT REQUEST FORM will be
checked for a billing error, either a classification issue
(reviewed by the Assessor) or a non-classification issue. If
there is an obvious error, the Superintendent of Public Works can
authorize the proper abatement at the bottom of the ABATEMENT
REQUEST FORM; otherwise the DPW Superintendent shall send a
NOTICE OF DISAPPROVAL to the applicant, which can then be
appealed within thirty (30) days on the APPEAL FORM to the
Landfill User Fee Committee.
The Landfill User Fee Committee shall consist of three members
appointed from their respective departments by the Building
Commissioner, the DPW Superintendent and the Director of
Municipal Finance. Once the committee has received an APPEAL
FORM, it shall make its best efforts to notify the applicant
within ten (10) days of the hearing date, using the NOTICE OF
HEARING. The committee shall then record the outcome of their
vote at the bottom of the APPEAL FORM and also send out either
the APPROVAL OF ABATEMENT form or the DENIAL OF ABATEMENT form.
A final appeal from the decision of the committee may be made in
writing within thirty (30) days to the Board of Public Works.
This amendment is adopted on the 15th day
