BOARD OF HEALTH/BOARD OF PUBLIC WORKS
The Minutes of the Meeting of July 11 1990 at 7: 30 PM. The
Meeting was held in the Board of Selectmen's Hearing Room, Town and
County Building, Nantucket, MA 02554. All members of the Board
were present with the exception of Mr. Viera. Chairman Grossman
called the meeting to order at 7:29 PM.

announced that this hearing which was inadvertently noticed in the
newspaper for June 12th will focus on the items not covered at the
earlier hearing.
.Riscussion of Policy for Trimming/Removal of Trees in Town of
Nantucket. Ms. Coombs stated that concern forms regarding the
trees on West Dover Street were received from Whit Bourne, Richard
Dober, Jackie Papale, Charles Cirigliano and Kimberly Fishman. Ms.
Coombs read the letter from the Electric Company dated July 9, 1990
offering a $1,000 donation to the Tree Fund.
Mr. Viera entered the meeting at 7:31 PM.
Mr. Jack Topham of the Electric Company stated that the Electric
Company is occaisionally asked by homeowners to remove trees and
that he was not aware of any restrictions on trees on private
property: he said the Electric Company did not mean to do malicious
damage to the trees, but that safety for the workers is a big
concern. Mr. Topham said that in the future as well in the past
the Electric Company will contact the DPW prior to starting tree
work. Chairman Grossman stated that a policy on tree work should
be compiled in accordance with MGL Ch 87 regarding Public Shade
Trees. The Board noted that Mrs. Tillotson, Mr. cirigliano and Mr.
Droz had submitted applications for appointment to the Tree
Advisory Committee. Chairman Grossman stated that there were five
openings and the Board should hold off on appointments until after
this has been advertised again and more applications come in. Mr.
Borchert stated that other communities require their utility
companies to plant trees vegetation. Mrs. Sevrens moved to accept
the $1,000 gift from the Electric Company to the Tree Fund.
Seconded by Ms. Coombs. So voted.
Mr. Whit Bourne submitted a petition with signatures from West
Dover area residents requesting that this money be earmarked for
their neighborhood. Mr. Grossman said it would be referred to the
Tree Advisory Committee for a recommendation. Mrs. Sevrens read
from MGL Ch 87 regarding marking of trees which is punishable by a
fine of $50. Mrs. Sevrens moved to notify the DPW and Police
Department of this law so that it could be enforced. Seconded by
Ms. Coombs. So voted.
Request by Abutters Petition for Town to Maintain Nobadeer Avenue.
Chairman Grossman stated that the petition submitted represented
over 50% of the lineal footage of a section of Nobadeer Avenue and
requested the Town to undertake temporary repairs to this private
way: he added that the DPW Superintendent should have a chance to
respond with his recommendation. Mr. Viera stated that he believed
the Town should maintain the road and that the gate placed by a
private individual should be removed as the Town owns abutting
property and did not agree to the blockade. Chairman Grossman said
that an estimate for repairs was needed. Fire Chief Bruce Watts
stated that he did not believe private individuals could block
private roads due to public safety issues and recommended obtaining
an opinion from Town Counsel. After a discussion, the consensus of
the Board was to request the DPW Superintendent to return next week
with a cost estimate for repairs and to obtain a legal opinion on
blocking of private roads used by the public. Chairman Grossman

requested that the DPW Superintendent prepare a prioritized list of
private roads used by the public.
Recommendations from Packaqinq Review Committee. After a brief
I discussion, Mr. Borchert moved on the recommendation of the
committee, to grant the exemption from the Biodegradable Packaging
Bylaw to Something Natural for 2 oz. and 4 oz. plastic cups with
plastic lids. Seconded by Mrs. Sevrens. So voted. Mr. Bruce
Perry stated that the committee was requesting the Board table the
second recommendation for one week. The Board agreed to do so.
Ms. Coombs read the memo from the committee dated July 9, 1990 with
suggested amendments to the Biodegradable Packaging Regulation.
After some discussion, the Board voted unanimously to set a Public
Hearing date for the proposed amendments dealing with the issues as
outlined in the letter of July 9, 1990 in August at the Siasconset
Casino for a date to be specified for the annual Sconset meeting.
The Board requested that the committee draft specific language for
the proposed amendments.
There being no further business before the Board, the Board voted
unanimously to adjourn at 8: 18 PM to reopen as the Board of
Selectmen.
