HomeMy WebLinkAbout1990-05-23 BOARD OF HEALTH The Minutes of the Meeting of May 23, 1990 at 7:30 PM. The Meeting was held in the Selectmen's Hearing Room, Town & County Building, Nantucket, MA 02554. All members of the Board were present. Chairman Grossman called the meeting to order at 7:30 PM. Approval of the Minutes of May 2. 1990 at 7:30 PM. Ms. Coombs moved approval. Seconded by Mr. Viera. So voted. Reading of the Minutes was waived. Variance Request: 310 CMR 15.00 Minimum Requirements for the Subsurface Disposal of Sanitary Sewaqe for Alixe Huqret. Wauwinet Road. Ms. Coombs read a memo from Health Inspector Ray dated May 18, 1990 recommending denial of the variance sought from section 15.03(7): Distance. Mr. John Shugrue said if the well was moved to the northwest as suggested by Mr. Ray, it would put it in the same area as the old system. He stated that the house is limited to two bedrooms and that the Conservation Commission had stated that the proposed location was the only place it could be located. Mr. Ray explained where he thought the system should go. Mrs. Sevrens stated that this application was for replacement of a failed system. After some discussion regarding location of the present well and wetlands boundaries, Mr. Borchert said the Board of Health should take no action until the applicant provides all information on the existing septic system's location. The Board generally agreed with Mr. Borchert. Variance Request: Town of Nantucket Board of Health Requlations 60.00 Minimum Lot Size for Unsewered Lots for Roy and Cynthia Egan. 11 Teasdale Circle. Ms. Coombs read a memo from Mr. Ray dated May 18, 1990 recommending the Board grant this variance. Mr. Ray stated that there will probably be about two more of these variance requests. Noting that the property owners properly obtained a septic system installation permit and unintentionally allowed it to expire, Mr. Viera moved to grant the variance as recommended by Mr. Ray. Seconded by Ms. Coombs. So voted. Mr. Ray suggested that there could be a blanket variance granted for Teasdale Circle residents. Ms. Coombs moved to grant a blanket variance for Teasdale Circle residents from the above-mentioned Board of Health regulation with the stipulation of a six-month deadline, until November 23, 1990, for obtaining the septic system installation permits which were unintentionally allowed to expire; and to direct Mr. Ray to notify all Teasdale Circle residents concerned. Seconded by Ms. Sevrens. So voted. Variance Request: 310 CMR 15.00 Minimum Requirements for the ,i Subsurface Disposal of Sanitary Sewaqe for Gary and SYlvia Rast. i Arkansas Avenue. Ms. Coombs read a memo from Mr. Ray dated May 18, 1990 recommending the Board grant the variances sought from sections 15.03(7): Distance and 15.02(18): Multiple Use with stipulations. Mr. Borchert moved to grant the variances sought with the stipulation that evidence of well relocation, including a water well completion report and an as-built location drawing of the completed well be submitted to the Health Inspector prior to issuance of the septic system installation permit. Seconded by Ms. Coombs. So voted. Subdivision Recommendation: Eiqht Lot Subdivision of Robert and Cynthia Jay. Quaise Pasture Road. Ms. Coombs read a memo from Mr. Ray dated May 15, 1990 recommending that all lots are acceptable for septic system design, with the understanding that all septic , systems should be located a maximum distance from Polpis Harbor and its associated Wetlands. Mr. Ray said that the lots meet the zoning requirements and are restricted on the design and placement of the septic because of the wetlands. Mr. Ray explained that this was a preliminary recommendation to the Planning Board. A discussion ensued regarding perc tests. The Board generally agreed Minutes of the Meeting of May 23, 1990 at 7:30 PM Page II that it would be a good idea to have an independent witness present when these tests take place; Chairman Grossman suggested that Mr. Ray look into whether it is legal for a municipality to charge a fee for this process. Mr. Viera moved to accept Mr. Ray's recommendation to the Planning Board as outlined in his memo of May 15, 1990. Seconded by Mr. Borchert. So voted.
