HomeMy WebLinkAbout1990-02-07 BOARD OF HEALTH The Minutes of the Meeting of Wednesday February 7, 1990 at 7:30 PM. The meeting took place in the Board of Selectmen's Hearing Room, Town and County Building, Nantucket, MA 02554. All members of the Board were present. Chairman Sevrens called the meeting to order at 8:05 PM. I ~pproval of the Minutes of December 6, 1989 at 7:30 PM. Mr. Viera moved approva ?econded by Mr. Grossman. So voted. Reading of the minutes was waived. Variance Re uest from Board of Health Re ulations 50.00 Section 50.02(B) and oard of Health Re ulations 51.00 Section 51.03(A): Edward and Janet Mur h , daket. Mr. Viera read the Health Inspector's letter dated February 1, 1990 ecommending denial of the first variance request. Mr. Ray explained that he property is currently unbuilt upon and that wetlands are a part of the roperty. Mr. Ray stated that in order for the septic system to go in as prop- sed, two Board of Health variances must be obtained: one requires 50 feet etween the leach facility and the property line; the other requires 100 feet rom the leach facility and wetlands. Mr. Ray stated that his concern was ~ncroachment on the abutting property, possibly restricting the relocation f the cesspool. In answer to Chairman Sevrens' question, Mr. Brown, attorney or the applicant, stated that this property is not now owned by Mr. Murphy, I powever he has a Purchase and Sales agreement, and that the owners, the Pearsons~ ere not making objection to this application. Mr. Brown said the property i ould revert to Barbara Pearson if the Purchase and Sales was not granted. I r. Ray said of bigger concern was the 100 foot variance sought; he stated I hat if this were granted the septic system could cause pollution in the Hither ! reek area by traveling nitrates since there is already poor circulation in he area. Mr. Ray recommended denial of the variance from 51.00 BOH 5].03(A). ! r. Brown pointed out that if Mr. Murphy won his lawsuit against the Conservati04 ommission and were able to place the septic where he originally wanted it, I 't would be more detrimental to the area. Mr. McLaughlin stated that the Board 1 as allowed this type of situation in the past in Madaket. Mr. Ray stated hat those were repair situations. Mr. Viera moved to deny both variance reques s, rom 50.00 BOH 50.02(B) and 51.00 BOH 51.03(A); seconded by Mr. Grossman. Ms. I oombs agreed, stating protection of the water was of utmost importance. Mr. I cLaughlin abstained. So voted. : i ubdivision Recommendation: Re roval of 4 Lot Subdivision off I outh Shore Road for Donald and Ph llis Visco. Mr. Viera read Mr. Ray's memo I f February 2, 1990 stating all lots are acceptable for septic system designs. : r. Viera moved to affirm Mr. Ray's recommendation to the Planning Board. secon1ed y Mr. Grossman. So voted. ubdivision Recommendation: 39 Lot Subdivision off Bartlett Road for Edith err. Mr. Viera read Mr. Ray's memo of January 26, 1990 stating all lots ust be connected to an approved sanitary sewer as all lots are less than 40,000 quare feet. Mr. Grossman moved affirming Mr. Ray's recommendation to the lanning Board. Seconded by Ms. Coombs. A brief discussion followed regarding allonage available. So voted. r. Ray apologized to the Board for any time his opinions or comments made ny Board member uncomfortable. here being no further business before the Board, the Board voted unanimously o adjourn at 8:46 PM to reopen as the Board of Selectmen.
