HomeMy WebLinkAbout1989-12-13 11 BOARD OF HEALTH/BOARD OF PUBLIC WORKS The Minutes of the meeting of Wednesday, December 13, 1989 at 7:30 PM. The meeting took place in the Selectmen's Hearing Room, Town & County Building, Nantucket, MA 02554. All members of the Board were present except Bernard Grossman. Chairman Sevrens called the meeting to order at 7:58 PM. Chairman Sevrens thanked everyone who attended the Special Town Meeting on December 12th and said that their presence was much appreciated. Approval of Minutes of November 2, 1989 at 4:30 PM. Mr. Viera moved approval of the minutes. Seconded by Mr. McLaughlin. So voted. Reading of the minutes was waived. Public Hearing to Consider the Adoption of Proposed Specifications for Sanitary ISewers for Nantucket. D.P.W. Superintendent Jeff Willett said that he had ~urther modifications due to comments from the consulting engineers, and he ~equested more time to finalize them. Mr. Viera moved to continue the hearing ~ntil January 3, 1990. Mrs. Coombs seconded the motion. So voted. I Pursuant to Board of Health Regulations 38.03: Re ulations Governin ections of Commercial Shellfish 0 enin Facilities. Ms. Barbara Charder Mr. Howard Wheldon were present. Health Inspector Richard Ray explained violation and described the circumstances behind it. Mr. Viera asked if ~s. Charder and Mr. Wheldon were in the process of getting their shanty legalize~. ~r. Wheldon replied in the affirmative. Ms. Charder stated that she had misundet- Istood the rules regarding commercial opening of scallops and that on the day ~"n question, she and Mr. Wheldon had been opening scallops in their shanty for personal use, not commercial use. Mr. Ray said that the quantity of scallop~ pened by Ms. Charder and Mr. Wheldon indicated that they were not intended I I Ifor personal use; furthermore, he had obtained a receipt from Charlie Sayle ~or scallops sold to Mr. Sayle by Mr. Wheldon. Chairman Sevrens stressed the "mportance and seriousness of the Health Inspector's duties regarding the icensing of scallop opening shanties. Mrs. Coombs asked Ms. Charder why the callops were not opened in a registered shanty. Ms. Charder repeated that I hey were not opening them commercially since they had used properly licensed ~acilities for opening scallops that were sold. Mr. Ray stated that Ms. Charder Fnd Mr. Wheldon had been informed by him, that they were not allowed to open callops in an unregistered shanty. Ms. Charder asked if someone would be llowed to open scallops for personal use in an unregistered shanty. Mrs. I oombs said that they were clearly not even opening for personal use since ' he family limit for scallops is one bushel per week and four bushels of scallop$ ere found in Ms. Charder's shanty. Mr. Viera moved to issue Ms. Charder and ! r. Wheldon a warning not to open in an unregistered shanty. Mr. McLaughlin econded the motion.
