HomeMy WebLinkAbout1989-07-19 BOARD OF HEALTH The Minutes of the meeting of July 19, 1989 at 7:30 PM. The meeting was held ~'n the Board of Selectmen's Hearing Room, Town & County Building, Nantucket, 02554. All members of the Board were present. Chairman Sevrens called he meeting to order at 7:33 PM. of the Minutes of June 22, 1989 at 4:00 PM. Mr. Viera moved approval; by Ms. Coombs. So voted. Reading of the minutes was waived. Variance from 40,000 S uare foot Minimum Lot Size for Sankat Trust. Mr. David Moretti, representing the applicant, Mr. Richard Glidden, sked that the Board continue the hearing since the applicant's engineer could ot attend the meeting due to the fog. Mr. Viera stated that individuals in pposition of the variance request should be allowed to speak. Mr. Peter Fenn tated that he represented the Land Council and the Siasconset Civic Association;1 e questioned the Board's authority to grant a variance. Mr. Viera stated that : r. Fenn should go ahead with his presentation and Mr. Glidden's engineer, Mr. aylor could make his presentation next week. Mr. Moretti stated he had no bjection to this and pointed out that Section 90.00 of the Board of Health egulations adopted February 17, 1988 allows the Board the authority to grant ariances. After some discussion, there was general agreement that the experts I~n both sides would speak next week, however, any Siasconset resident could peak on the hearing at tonight's meeting. It was noted that no one in the udience spoke in favor of the variance request. Mr. Donald Hallerman stated ~hat, as an environmental engineer, he was concerned about the water resources. I~e stated that the present Health regulations were based on careful studies. iMs. Jean Crapsey, President of the Siasconset Civic Association, stated that ~he number one priority was retaining pure water for Sconset; she recommended ~hat the Board deny the variance request. Ms. Crapsey submitted a petition ligned by 400 Sconset residents to this effect. Mr. Moretti read Mr. Glidden's etter to the Board of July 12, 1989 at Mr. McLaughlin's request, questioning I he validity of the 40,000 sq. ft. minimum lot size regulation. Mr. McLaughlin I tated he agreed with the points brought up in the letter, stating there should e a stipulation on the number of bedrooms regarding square footage and that there should be a limit on the gallons per day being discharged. Mr. McLaughlin oved continuing the hearing on this variance request until next Wednesday, II uly 26, 1989 at 7:30 PM. Seconded by Mr. Ramos. The Board asked that Mr. ~oretti supply any new information to Mr. Fenn and Mr. Fenn submit any new jl'nformation to Mr. Moretti. So voted. Chairman Sevrens suggested asking if he Court room would be available for next week's meeting. r. McLaughlin moved setting a Public Hearing date for August 9, 1989 at 7:30 1M for a proposed amendment to the 40,000 Square foot Minimum Lot Size Health : I egulation to consider limiting the gallonage to 440 gallons per day. Mr. Tillo~son tated that there must be a scientific reason with backup data in order to adopt i I uch an amendment. Mr. Bourgoin agreed with Mr. Tillotson. Mr. Moretti stated i he exact text of the proposed amendment should be advertised in the newspaper . ,brior to the hearing. Seconded by Ms. Coombs. Mr. Ramos opposed the motion. So voted, 3 votes to 1. I r. McLaughlin moved to hold the Board of Health/Board of Selectmen meeting I 'n the Siasconset Casino on August 9, 1989 at 7:30 PM. Ms. Holdgate stated I hat this site was not readily accessible to some people. Seconded by Ms. Coomb r. Ramos abstained from the vote. So voted, 3 votes to O. I I here being no further business before the Board of Health, the Board voted I nanimously to adjourn at 8:20 PM to reopen as the Board of Selectmen.
