HomeMy WebLinkAbout1989-06-22 '1 BOARD OF HEALTH The Minutes of the Meeting of Thursday June 22, 1989 at 4:00 PM. The meeting took place in the Selectmen's Hearing Room, Town & County Building, Nantucket, MA. Selectmen present were Nancy Sevrens, Wayne Viera and John McLaughlin. The Board of Selectmen voted unanimously to open as the Board of Health at 5:35 PM. Chairman Sevrens opened discussion of the septic system application for Cobblest?ne Village, saying that the recommendations of DPW Superintendent Jeff Willett and Wannacomet Water Company Manager David Worth were needed. Attorney Spencer Cowan presented a letter from Supt. Willett. Mr. Viera said that the Board had voted to endorse Health Inspector Richard Ray's recommendation to the Plan- ning Board. Engineer Neil Murphy said that Mr. Ray's condition B could be met with a clay liner. He said that Mr. Worth would not return to the island for one or two days. He said that Weston & Sampson engineers had said that there would be no impact but they would not put it in writing because it was outside their present contract for services to the Town. He suggested that the Selectmen discuss the issue with Rob Sloan. Ms. Coombs joined the meeting at 5:40 PM. Attorney Ted Tillotson said that the Board should either rely on the Health Inspector's recommendation or not. Mr. Viera said the approval could be contin- gent on information being made available in the future. Mr. Tillotson said that the system was routine and a letter from the applicant's engineer had been provided which testified that the nitrates would be within the safety requirements. Mr. McLaughlin asked what the distance was between the proposed system and the aquifer zone. Mr. Murphy said 500 feet and explained the plan. He said that the clay liner would retard pathogens but not nitrates. He said the amount of nitrates would be insignificant. He said the water table was 20 feet below the proposed system and that it would take the discharge two hours to reach the water, travelling horizontally. Mr. Tillotson said the arrangement would last only until a sewer connection was available and that a bond would be posted with the Town. Supt. Willett said that the clay liner would only trap the pathogens but that they would die off eventually. Mr. Bourgoin said that the Board could change their initial vote and endorse item #5 on the Planning Board's decision. Mr. McLaughlin said that protection of Nantucket's water was important and that Mr. Worth's recommendation should be obtained before a decision was made. Mr. Murphy said he would meet with Mr. Worth and any interested Selectmen. Building Inspector Ron Santos said that there were time limits involved. Mr. McLaughlin said that he needed more information. Mr. Viera said that the applicants had complied with the relevant regulations and specific stipulations. Ms. Coombs said the approval could be contingent on Mr. Worth's subsequent approval. Mr. McLaughlin firmly stated his opposition to the action and said that if the vote went through he would be denied his rights as a Selectman. Mr. Viera moved approval of the septic system plan for Cobblestone Village as recommended by the Health Inspector I with restriction B as outlined in Mr. Ray's memo of June 6, 1989 and in accor- Idance with Item #5 of the June 12, 1989 Planning Board's decision in Amendment I No.1 to Special Permit 1-87 FRA Trust/Cobblestone Village MCD.; seconded by I IMs. Coombs. So voted by 3 to 1 with Mr. McLaughlin opposed and Chairman sevrensll' in favor.
