HomeMy WebLinkAbout1989-06-21 !l BOARD OF HEALTH/BOARD OF PUBLIC WORKS The Minutes of the Meeting of Wednesday June 21, 1989 at 7:30 PM. The meeting took place in the Board of Selectmen's Hearing Room,Town & County Building, Nantucket, MA 02554. All members were present. Chairman Sevrens called the meeting to order at 7:33 PM. Sewer Policy. Chairman Sevrens reported that the Town had ironed out most points in the objection to Administrative Order No. 782 except one point and ~t was Town Counsel's recommendation to have the Board direct him to reserve the right to appeal. Mr. Viera moved authorizing Town Counsel to reserve the right to appeal the Order if no compromise is reached by the deadline. Seconded by Ms. Coombs. So voted. Attorney Kevin Dale asked to have made known what points the Town was in accord with in the negotiaions. Town Counsel Paul DeRensis advised that it was not appropriate to divulge this information since the negotiation process was still ongoing. Mr. Dale asked what information could be given out. Mr. DeRensis stated that the matter was not final until the state has issued an amended Order. Mr. Viera moved authorizing Town Counsel to appeal the Order if no agreement is reached with the State; seconded by Mr. McLaughlin. Mr. DeRensis stated that the appeal could always be withdrawn. So voted. Mr. Ramos moved placing the issue on the agenda on Friday June 23, 1989, the deadline given by the Town for the state to agree, if an amended order is received. Seconded by Mr. Viera. So voted. Cobblestone Village. Mr. Ramos abstained and left the meeting at 7:50 PM. Attorney for the applicant seeking approval of the septic system, Spencer Powers, stated that the plan was restricted to 5 units and asked Board of Health approval of the plan. Health Inspector Ray stated that the plan was acceptable with the clay liner and the cutback in flow. Engineer Neil Murphy stated that the flow was 1,765 gallons per day. Senior Planner Brian Wiese stated that Weston & Sampson engineers agree that the nitrate level was not significant. Mr. McLaughlin thought the septic system was too close to the acquifer. Mr. Murphy stated that the plan was in compliance with title 5 and assured the Board that it would not destroy the water aquifer. Ms. Lynn Zimmerman stated that title 5 was a minimum state requirement and that the Board of Health could issue more stringent requirements. Mr. Viera moved approval of the septic system as presented in the plan. The motion died for [ack of a second. Mr. McLaughlin moved to table the matter for two weeks in order to hear from Water Department Manager David Worth and Town engineers ~n writing. Mr. Viera seconded the motion. Mr. Powers stated that the applicant ~.ad time restrictions due to the 30-day period in which the Building Inspector ~ust review the proposal. Mr. McLaughlin withdrew his motion. Ms. Coombs #oved to table the matter until a written report regarding nitrate intrusion #as received from Weston & Sampson, and letters from DPW Superintendent Jeff ~illett Mr. Worth are received. Mr. Wiese stated he was not sure a letter rom Weston & Sampson would be forthcoming, that it might be outside of the ,own's contract with them, but would request a letter. Seconded by Mr. McLaughli~ ,0 voted. i ~r. Ramos returned to the meeting at 8:10 PM. ii is osal of Sewa e from Nantucket Boat Basin. Chairman Sevrens abstained nd left the meeting at 8:10 PM. Mr. Viera read the letter dated June 15, 989 and DPW Superintendent Willett's memo of June 18, 1989. Mr. Viera stated hat the concerns the Board had were regarding large cruise vessel dumping nto the harbor and possibly dumping into the sewer system illegally. Mr. iera asked if these vessels needed a special permit to discharge sewage. s. Coombs and Mr. Ramos stated it was important to obtain facts and figures 'egarding holding capacity for sewage. Mr. Steve Bender stated certain vessels ere caught discharging sewage in the harbor since the holding tanks only old effluent for a limited time. Health Inspector Ray stated he had requested nformation from the cruise vessels was expecting it shortly. Ms. Coombs oved to authorize Mr. Ray to require the operators of the large cruise vessels o demonstrate to him the capacity of the holding tanks and place a time limit Rn the stay of these vessels according to their capacity if the pump-out station ~s not being used, should any of these ships arrive before the pertinent informa- ~ion is gathered. Seconded by Mr. McLaughlin. Mr. Ramos opposed the motion. $0 voted by a vote of 3 to 1. Chairman Sevrens returned to the meeting at 8:30 PM. Mr. Ramos moved to direct Health Inspector Ray to send a letter to all large ;1 oruise vessel operators requiring that they comply with state and local regulations. Seconded by Ms. Coombs. Page II. ~ealth Inspector Ray reported on the Harbor Water Quality Testing program which ~ad been expanded to Madaket and Polpis Harbor. He stated the Harbor Management ~lan was anticipated next week and he would then begin testing the water at all ~ublic beaches. Mr. Bender stated that Mr. Ray should be commended for his Harbor nitiative. here being no further business before the Board of Health/Board of Public Works, he Board voted unanimously to adjourn at 9:06 PM to reopen as the Board of electmen. rtt.. ubmitted for review the:;...f day of July 1989.
