HomeMy WebLinkAbout1989-03-08 II BOARD OF HEALTH The Minutes of the Meeting of Wednesday March 8, 1989 at 7:30 PM. The meeting took place in the Selectmen's Hearing Room, Town & County Building, Nantucket, MA 02554. All four members of the Board were present. Chairman Cabot called ,the meeting to order at 7:38 PM. Mrs. Sevrens read a joint policy statement from the Fire and Health Departments which said: I"EFFECTIVE IMMEDIATELY: Following the discharge and or spill of a hazardous Imaterial within the jurisdiction of the Town of Nantucket and its waterways, harbors, and foreshores, the resultant clean-up, storage and removal of said spilled material shall be the responsibility of the individual or company res- !'ponsible for the spill and/or the owner of the property where the incident I,occurred. Ii "This posture is proposed to eliminate any Town liabilities with respect to temporary storage of contaminated materials in unsecured unlicensed areas. In the event of a major hazardous materials incident, this policy statement I shall not preclude the emergency (by order of Fire and Health Officials) use of Town property (landfill) for the temporary storage of the contaminated ,materials (not to exceed 30 days). :"The Fire and Health Departments shall continue to function in a regulatory jand advisory capacity for all materials spilled." IHealth Inspector Richard Ray explained the history of oil response teams. He Isaid that the individuals responsible for spills must clean them up. He said Ithat the Fire and Health Departments would provide guidelines, but that the Iresponsibility would rest solely with the property owner. He said homeowner's linsurance would cover such liability. IMrs. Sevrens asked if spills would be cleaned up right away. Mr. Ray said iyes, that the Fire Department would respond immediately, but the costs of clean- !up would be up to those responsible. Mrs. Sevrens asked where the materials Iwould be stored after clean-up and before removal from the island. Mr. Ray II/said in containers on the owner's property. Fire Chief Bruce Watts said he agreed 100%. Mr. Ray said other policy statements would follow. IllThere being no further business before the Board of Health, the meeting was adjourned at 7:45 PM to reopen as the Board of Selectmen. I Submitted for approval the 2/~ay of March 1989. " Ii I !
