HomeMy WebLinkAbout1989-01-25 II BOARD OF HEALTH ,The Minutes of the Meeting of Wednesday January 25, 1989 at 7:30 PM. The ~eeting took place in the Selectmen's Hearing Room, Town & County Building, Nantucket, MA 02554. All four members of the Board were present. Chairman , I ! ICabot called the Board of Health to order at 7: 45 PM. IThere was unanimous approval of the Minutes of January 18, 1989 at 7:30 PM. ~eading of the minutes was waived. I ~rs. Sevrens read a variance request from section 15.03 (7) distances submitted I Iby Ms. Pati Booker, Map 80, Parcel 41, Field Avenue. Health Inspector Richard Ray recommended granting the variance. Mr. McLaughlin asked how many feet !the variance would involve. Mr. Ray said less than 100 feet. Mr. McLaughlin asked what effect there would be on nearby wells. Mr. Ray said none. There tas unanimous approval of the variance from section 15.03 (7) for Ms. Pati ,Booker, Map 80, Parcel 41, Field Avenue. ! :~rs. Sevrens read a variance request from 310 CMR 15.03 and Madaket Regulations Idistance submitted by Mr. Bruce Perry, Map 59.3, Parcel 170, Midland Avenue. IHealth Inspector Ray recommended granting the variance. After brief discussion lof impact on water in the area, Mr. Viera moved approval of the variance from ,310 CMR 15.30 and Madaket Regulations distance for Mr. Bruce Perry, Map 59.3, iParcel 170, Midland Avenue; seconded by Mrs. Sevrens. So voted. I I ITown Clerk Joanne Holdgate pointed out an enforcement provision which had [been overlooked in the new "Biodegradable Packaging" bylaw. She said the Ipenalty was $50 for each offense and could be enforced through the noncriminal :disposition procedure allowed under M.G.L. C40 S21D. IChairman Cabot opened discussion of fines for uncovered lIt was recommended that a $50 penalty could be enforced lof Selectmen/Board of Health declared that it is a Town !Mrs. Sevrens moved approval of a $50 fine for uncovered ,as a Town Health Ordinance; seconded by Mr. McLaughlin. He asked the public to bring any !such material directly to him. He stressed that AIDS could not be contracted [from such a needle. Mr. McLaughlin asked what kind of syringe had been found. IMr. Ray said it was for insulin. Mr. Barnes asked if there was any indication IWhere the debris originated and what was being done about the problem. Mr. Ray said that the debris is all generic and the source unknown. He said he Iwas in contact with the State biweekly and that the search for the source liS a state and federal responsibility. jThere being no further business before the Board of Health, the meeting was ladjourned at 7:59 to reopen as the Board of Selectmen. i r-J.
