BOARD OF HEALTH
The Minutes of the Meeting of November 2, 1988 at 7:30 PM. The Meeting took
place in the Selectmen's Hearing Room, Town & County Building, Nantucket,
MA 02554. All members of the Board were present except Mr. Clute. Chairman
Cabot opened the meeting at 7:28 PM.
Mrs. Sevrens read a memo from Health Inspector Richard Ray outlining his
observations concerning the Topland Properties 57 lot subdivision located
off Low Beach Road. Mr. Ray wrote that the property extended from Low Beach
Road northerly approximately 2320 feet abutting the Siasconset wellfield
and that all lots were accessible to the Siasconset sewer facility through
existing dry sewer lines. He recommended approval of the subdivision providing
all lots would be issued a Sewer Entrance Permit prior to any and all
construction. He said that in-ground disposal of sewage was not
recommended due to the small size of the lots and the potential for nitrate
overloading of soil and ground water abutting the local municipal wellfield.
He suggested that the Board recommend air pressure and ~~ndrel tests of the
existing dry lines to ensure tightness prior to the application of any and
all road surfacing materials.
Mr. James Lengyel of the Planning Board said that this application was on
the Planning Board's agenda and they found no problem with Mr. Ray's report.
Chairman Cabot asked whether there would be any variances involved and Mr. Ray
said only if in-ground septic systems were approved. Mr. McLaughlin asked
whether DPW approval was needed. Mr. Jack Gardner said that local and state
DPW approval were both required and that the state permit had been obtained.
Mr. McLaughlin expressed concern for the impact of the influx on the sewer
beds. Mr. Gardner said that the Town beds referred to as the Coast Guard
beds would be moved as part of the Surfside and 'Sconset treatment areas.
He said that the state sets the requirements and that the influx could be
shut off if it went over the limit. Mr. McLaughlin said the Board should
know how many gallons the system would take before approving the application.
Mr. Gardner said the system would take 29,000 gallons and had already received
a state permit. Mr. McLaughlin asked if the sewer beds could accomodate this
amount. Mr. Ray answered that the state said yes. Mr. McLaughlin asked if
!the roads were in yet. Mr. Ray said no. Mr. Lengyel said the roads were
: graded but not tarred and that Weston & Sampson Engineers would observe
the testing and tell the applicants where changes need to be made.
Mr. David Moretti asked about a 1963 appeal and questioned whether the sewer
beds were ever approved under Massachusetts General Laws. He asked who owned
the existing pipeline, the Town or the federal government. He said if the
Town did not own the pipeline, rights might be challenged in the future and
there might be problems with responsibility for maintenance. Mr. Ray had
no comment on these questions. Mr. Gardner said that the Town usually owns
pipes for a certain distance from the road. He also said he believes that the Town
owns the sewer mains, although they had been named the Coast Guard lines
simply because that's who used them. Mrs. Sevrens made a motion that the
Board accept Health Inspector Ray's recommendation to approve the subdivision
providing all lots be issued a Sewer Entrance Permit prior to any and all
construction, to disallow in-ground disposal of sanitary sewerage, and to
recommend testing of the existing dry line prior to the application of any
and all road surfacing materials; seconded by Mr. Viera. So voted.
Mr. Ray thanked the Board for hearing the matter, especially since he had
been late for the agenda deadline. Mr. Bourgoin said that the Selectmen's
Office would send out a memo to all departments that the deadline will be
strictly enforced in the future.
There being no further business before the Board, Chairman Cabot adjourned
the meeting at 7:45 PM to reopen as the Board of Selectmen.
