BOARD OF HEALTH
The Minutes of the Meeting of Wednesday August 3, 1988 at 7:30 PM.
The Meeting took place in the Selectmen's Hearing Room, Town and County
Building, Nantucket, MA 02554. All members of the Board were present
except Mr. Clute. Chairman Cabot called the Meeting to order at 7:30
PM.
Fine issued to Royal Caribbean Cruise Line. In a letter Inspector
Ray reported that a $200 fine was levied because a canister of hazardous
fluids apparently from the Nordic Prince washed up on a beach on the
south side of Nantucket. Mrs. Sevrens read the letter. Inspector
Ray is working with Howard Wensley of the Stae Department of Health
on waste found on beaches. Four items have been found which are traceable.
Variance request from Madaket regulations by Cynthia Grilli of C Street.
Mrs. Sevrens motioned approval. Seconded by Mr. Viera. So voted.
Inspector Ray also spoke of the mosquito problem, but he asked the
i Board for additional restraint before action is taken to open the
ponds. He introduced Mrs. Greenhill of the Sesachacha Pond area who
said that she had been in contact with Lee Lyman of an environmental
research firm which could do a study; she is willing to sponsor research.
Mr. Viera cited the study which had been done by Ken Kelly and also
suggested that testing in wells near the seacoast would show what
effects the salt water nearby would have on wells. Studies already
exist. Lee Lyman president of Lycott Environmental Research spoke
about how a study should be done. This is similar to the North Scituate
pond which he has been managing for the past few years. Within a
week previous reports could be studied and a budget for the study
could be determined. Mr. Cabot said the Town had no funds. Mrs.
Greenhill said that private sources would provide seed money and she
would be willing to help. Mr. Viera said that this did provide a
new perspective on the situation.
Adjourned at 7:55 PM as Board of Health. Reopened at 7:55 PM as Board
of Health/Board of Public Works.
Public Hearing date for change in sewer regulations.
Secretary recommends the date of August 10, 1988 at
Viera motioned approval. Seconded by Mrs. Sevrens.

Request for waiver of sewer connection fee. In a letter from Small
Friends of Nantucket, this waiver is requested for the affordable
daycare facility proposed on Nantucket Cottage Hospital grounds. Mr.
Cabot asked how much the waiver would be. Mr. Gardner responded that
he believed it would be $2,000. Mrs. Hannah Haynes read a critical
letter on the move onto hospital grounds. Mr. Grossman said the comments
are not pertinent to the matter at hand. Mr. McLaughlin and Mrs.
Sevrens did not know whether waivers should be done for all nonprofit
organizations; this may set a precedent. Mr. Grossman said that the
Town has a need, plus the Town has been saved $5,000 in reduced
demolition. Mr. McLaughlin motioned to deny the request. Seconded
by Mrs. Sevrens. So voted.
Mr. McLaughlin motioned (under fisheries act and under "emergency
measure" for mosquito and bug control) to open all ponds to the sea,
with all required assistance from DPW or volunteers. Mr. Viera seconded
the motion. Mr. McLaughlin commented that DPW should be ordered to
take action to open the ponds. Mr. Gardner suggested there may be
a trespassing issue, but Mr. McLaughlin said that he has researched
the law which says there is no trespassing if done under an emergency
measure. Mr. Grossman said that penalties may be very high to the
Town in the order of $25,000 per day from State agencies so that
he suggests first getting a legal opinion. Chairman Cabot responded
that the Board did have a legal opinion and the Town Counsel does
not back this action. He advised against. The Executive Secretary
then advised against this action. Mr. McLaughlin and Mr. Viera voted
for the motion; Mrs. Sevrens voted against, and Chairman Cabot then
voted in favor. The motion to open the ponds carried.
There being no further business before the Board, Chairman Cabot adjourned
the Meeting at 8:22 PM to reopen as the Board of Selectmen.
