HomeMy WebLinkAbout1986-01-22 II BOARD OF HEALTH Minutes of January 22,1986 Meeting The meeting was called to order at 7:34 p.m. by Chairman Gardner. All members were present. Mr. Cabot moved for approval of the December 18 and 30, 1985 minutes; seconded by Mr. Clute; so voted. Mr. Richard Ray, Health Inspector, presented to the Board new requlations con- I cerninq shellfish. He statEd that these regulations are tougher on those I scallopers who are opening in un-licensed "shanties". The Board has the power to set an appropriate fine for this vioaltion; once set, the regulations and the fine will be published in the Inquirer & Mirror, with the effective date specified as the date of publication. Mr. Cabot moved to adopt the following: I II I I I 1. All commercial shellfish shall be opended in a facility which has been inspected and approved by the Board of Health of the Town of Nantucket. i 2. All facilities shall be inspected for approval yearly and approval stickers shall expire March 31st of each year. 3. All violations of these local regulations shall be reported to the Board of Health with a recommendation by the Health Inspector as to any penalty to be imposed if the Board should find a violation. 4. Within five (5) days of the mailing of any notice of violation, the party charged may request a public hearing on the charges. If no such request is received within the specified time froma, the Board of Health shall decide the matter upon the facts reported to them by the Health Inspector PENALTIES: Any person who shall be found in vioaltion of these regualtion shall: 1. Upon First Offense: fine up to Two Hundred Dollars ($200.00 2. Upon Second Offense: surrender their Commercial Shellfish License for seven (7) days and be subject to a fine not to exceed Two Hundred Dollars ($200.00); 3. Third Offense: revocation of license for a minimum of 365 days and fines not to exceed Two Hundred Dollars ($200.00). EACH DAY OF A CONTINUING VIOLATION SHALL BE TREATED AS A SEPARATE OFFENSE. Motion for said adoption was seconded by Mrs. Sevrens; so voted.
