Amendment to Regulations of Minimum Lot Size For Unsewered Lots:
A letter from Richard Ray, Health Inspector, recommending Board's approval
of an amendment to Section 1 of the Regulations of Minimum Lot Size for
Unsewered Lots which was originally passed on November 14, 1984. Officer Ray
explained that at least two subdivisions have been approved where forty
thousand square feet or greater lots have been created and a separate lot or
lots with existing structures of less than 40 thousand square feet have been
incorporated into the plan. t-1r. Ray added .'although not within the purpose
or intent of the Regulations, these situations have occurred due to less than
precise wording of Section One of the Regulation."
"To rectify this situation, this office proposes the following rewording
of Section One of the Regulations in the form of an Amendment:
"1. No on-site septic system permit shall be approved by the Health Inspector I
which is proposed to be located on a lot with an area of less than 40,000
square feet; nor, shall any person use an existing septic system which is
located on a lot created after the effective date of these regulations and
which has less than 40,000 square feet."
Mr. Ray was present to answer any questions from the Board. He used the
blackboard to diagram an example of a lot which could, if subdivided, create
an area of less than 40,000 square feet.
The Board agreed with l1r. Ray that section one should be reworded in order
to close the loophole in the Regulations and contribute to the protection
of our fresh water aquifer.
Bernard Grossman moved to approve the reco~~ended rewording of
of the Regulations and publish them in the Inquirer and Mirror
by law, seconded by Bud Clute, so voted.
