HomeMy WebLinkAbout1985-08-14 Ii BOARD OF HEALTH Hinutes of August 14, 1985 Heeting The Board of Health's meeting comnenced at 7:30 p.m. All members were in attendance. The minutes of the July 24, 1985 and August 7, 1985 meeting were accepted as typed and reading of the same was waived on a rrotion from Skip CaJ::xJt, seconded by Bud Clute, so voted. Adoption of Underground Horne Heating Fuel Tank Regulations: The Planning Corrmission recorrmended that the Board of Health adopt its proposed amendments to the Underground Fuel and Chemical Tank Regulations to address the problems of leaking underground fuel oil tanks. The Planning Corrrnission held six public workshops with home heating fuel distributors and held an advertised public hearing on July 15, 1985. Skip CaJ::xJt made the rrotion to accept these regula- . tions, seconded by Bud Clute. Richard Ray, Health Inspector, was asked to I respond to the Board wi thin 4 weeks regarding neoprene tanks. I Regulations Prohibiting Dumping Sewage in Island Waterways: Richard Ray, Health Inspector, recorrmended, as requested by the Board at last week's meeting, the establishment of the following regulation as a Board of Health regulation by sirrply printing the regulations in the paper: I "No person shall dispose of, or if in control of any vehicle, boat or other conveyance, allow to be disposed of, in or on any Way to which the public has access, or in or on any stream, pond, creek, waterway, estuary, harbor, beach or foreshore in the Town of Nantucket, any garbage, refuse, bottles, cans, containers, sewerage or other refuse material of any kind or nature." "Any person violating this By-laW shall be punished by a fine of not rrore than 1$200.00 dollars for each offense." :The Board requested that a copy of the regulations be sent to the Woods Hole Coast Guard and local Coast Guard asking for their help in enforcing such. Mr. Grossman rroved that these regulations be adopted with enthusiasm, seconded by Skip CaJ::xJt, so voted. The Board also suggested that Mr. Ray put a notice in the paper asking for the public's help in this matter. Variance Request from Regulations Affecting Badaket: William Cassebaum, Washington Avenue, Madaket: Richard Ray recomnended that the Board grant a Ivariance for the lot on Washington Street from Section 4 and subsection 1 of the I'1adaket Regulations as follows: 11) This is a failed septic system serving as existing dwelling on an under- .ISiZed lot. 2) With relocation of the existing well to the Washington Street side of the lot, the placement of the new leach pit effects increased ,distances between all wells and leach facilities in the area. 3) With these I increased distances, this office is of the opinion that this proposed repair of a failed system offers increased protection for the corrmunity surrounding Ithe affected lot. I Bud Clute made the motion to accept recommendation, seconded by Skip CaJ::xJt, so voted. I Request for Public Hearing on Violation of Board of Health Regulations prohibitinq the deposit of shellfish shells within one and half miles from II Pacific National Bank: Health Inspector Richard Ray requested that the Board .Iof Health set a hearing for August 21, 1985 pursuant to 105CNR400: State 'Isanitary Code: General Administrative Procedures: Sec. 400-500 to determine I whether or not the owners of 104 Bain Street, Scott Follansbee and Reginald I II Barden , should be found quilty of depositing untreated shells in their driveway. ! IMr. Ray requested that if the Board finds a violation of the Health Regulations I'that they be directed to rerrove the shells and that a fine of $200.00 be imposed on Messrs. Follansbee and Barden in accordance with r-x;L Chapter 111, I section 3l. I The Board recomnended that sarrples of the untreated shells be taken for evidence. I Bernie Grossman moved to having a hearing on August 21, 1985 and to notify labuttors of such a hearing, seconded by Skip CaJ::xJt, so voted. I ~ Anchorage 80 bacterial/10 fecal; Boat Basin 1100/400; Children's Beach 700/200; Francis Street Beach 900/300 (Mr. Ray reccmnended that Francis Street Beach remained closed); Jetties Beach 40/20; Sesachacha Pond 20/10.
