All members present: Chainnan Bernard Grossrran, Charles "Jack" Gardner, Harry "Bud" Clute, Rogers "Skip" Cabot and Nancy Sevrens. Also in attendance, Acting Executive Secretary Barbara Dale & Health Inspector Richard Ray. Minutes of the Noverrber 14th and 19th were accepted as typed and reading of the same was waived on a notion from Selectnen Cabot, seconded by Select:m2I1 Clute, so voted. Health Regulations: Min.inn1m Lot Size for unsewered Lots: Confirmation of original vote of November 19, 1984 Public Hearing. Selectnen Cabot noved to approve, seconded by Selectnen Clute, so voted. Mr. Ray, in attendance for discussion, stated rrany other tavns have inquired into the information gathered in regard to approved health regulations. He stated he would like Board of Selecbren I s approval to cooperate with other towns. Mr. Chainnan stated they would gladly cooperate with other towns. He added, many towns also sen(f their congratulations on the new approved health regualtions. "" -OltA1l1)~..' .,.......".,,' TOWN OF NANTUCKET County Commissioners Town and County Building Nantucket, MA 02554 (617) 228-6800 Board of Health NANTUCKET BOARD OF HEALTH HEALTH REGULATIONS: MINIMUM LOT SIZE FOR UNSEWERED LOTS WHEREAS, the Board of Health is empowered to make reasonable health regulations within the Town of Nantucket pursuant to Chapter 111 of the General Laws of the Commonwealth; and WHEREAS, the Board of Health finds that the long-term integrity of the Island's ground water quality will be adversely affected if on-site septic systems are relied upon to dispose of wastewater in new subdivisions in which such systems are installed and used at a density greater than one such system per dwelling unit for each 40,000 square feet of lot area; and WHEREAS, it is in the interest of public health that public sewage collection facilities be encouraged to expand service to include those areas where on-site septic systems would otherwise be installed and used at a density greater than one such system per dwelling unit for each 40,000 square feet of lot area; and WHEREAS, the Town has adopted a comprehensive growth policy entitled "Goals and Objectives for Balanced Growth" in which GOAL B- "Protection of Water Resources"- states that it is the objective of the Town "to control the location, density, and design of on- site septic systems in unsewered areas in order to reduce threats to ground and surface water quality caused by their long-term cumulative use", and WHEREAS, a number of studies, both on-and off- island including two studies, "Water Resource Management Study, Nantucket, Massachusetts" 1984 and "Report on Subsurface Disposal of Sewage, Nantucket Island" 1973, show that currently permitted septic system densities would result in significant nitrate pollution to the Island's ground water; NOW, THEREFORE, the following regulation is adopted by the Board of Health: 1. No on-site septic system permit shall be approved by the Health Inspector which is proposed to be located on a lot with an area of less than 40,000 square feet; nor, shall any person use an existing septic system which is located on a lot created after the effective date' of these regulations and which has less than 40,000 square feet. 2. No on-site system permit shall be approved by the Health Inspector for a second dwelling located on a lot with an area of less than 80,000 square feet. BOARD OF SELECTMEN TOWN OF NANTUCKET 3. The Board of Health may waive strict compliance with this regulation for cluster subdivision plans as defined in the Nantucket Zoning By-Law (Section 4A2, Code Ch. 139, ~ 7B), as follows: (a) for lots not served by a community water system, minimum lot size shall be 20,000 square feet for each dwelling unit; (b) for lots served by a community water system, minimum lot size shall be 10,000 square feet for each dwelling unit. A waiver for cluster subdivision plans shall require a finding by the Board of Health that the configuration of septic system locations in relation to the location of common open space serves to ad~quately protect ground water quality on and adjacent to the site. 4. This regulation shall apply only to lots shown on plans endorsed by the Planning Board pursuant to M.G.L. Chapter 81 after the effective date of these regulations provided, however, that plans submitted prior to said effective date but not yet endorsed shall be exempt from these regulations in accordance with the conditions set forth in M.G.L. Chapter 111, ~127P. 5. This regulation and Amendments thereto became effective after publication in a newspaper of general circulation in Town of Nantucket. 6.
