Charles "Jack" Gardner, Harry "Bud" Clute, Rogers "Skip" Cabot, Nancy Severns and Acting Executive Secretary Barbara Dale. Richard Ray, Health Inspector also in attendanoe. Minutes of October 24, 1984 were read and waived on a rrotion from Selectrren Cabot, seconded by Selectrren Clute, so voted. Septic System Regulations: The Nantucket Planning & Economic Develop.rent Comnission would like to recx:>I'('[reIld to the Board of Health that pursuant to its powers under Chapter 111 of the Massachusetts General Laws, it adopt Health Regulations for minimum lot sizes for unsewered lots to protect the long-term integrity of the Islands' ground water quality, which will be adversely affected if on-site septic systems continue to be installed, at a greater density than one such system for each 40,000 square feet. I I i I i william Klein, in attendanoe to reconmend that the Board of Health schedule a public hearing to review the following proposed regulations: 1. Non on-site septic system permit shall be approved by the Health Inspector which is proposed to be located on a bt with an area of less than 40,000 square feet. 2. No on-site septic system shall be approved by the Health Inspector for a second dwelling located on a lot with an area of less than 80,000 square feet. I I I i I. II I I 3. The Board of Health may waive strict corrplianoe with this regulation in cases involving cluster subdivision plans pursuant to Chapter 139) section 7B of the Code of the Town of Nantucket (the Zoning By-Law) provided that no such waiver shall approve an on-site septic system perrni t in a cluster subdivision which is located on a lot containing (a) less than 20,000 square feet for each dwelling unit septic system for cluster subdivisions which rely upon individual on-site wells for domestic water, or (b) less than 10,000 square feet for cluster subdivisions which rely upon a comnunity water system. A waiver for cluster subdivision plans shall require a finding by the Board of Health that the configuration of septic system locations in relation to the location of (X)llY'[On open spaces serves to adequat~ ly protect ground water quality on and adjacent to the site. 4. This regulation shall not apply to lots lawfully in existenoe prior to the effective date of this regulation. 5. This regulation shall become effective on the date it is voted by the Board of Health. Sele c tmen Gardner suggested next Wednesday night to hold public hearing in Court Roam at 7: 00 p.m. before Board of Selecbne n meeting. Mr. Bob Mooney, in attendanoe for discussion, stated this seerred to be a abrupt way for such a zoning change and cautioned the Select:.Iren. as to the legalities , of such an action. Mr. Chainnan stated reason for a public hearing is for i public input on this matter. Mr. Chairman asked if everyone was in agreerrent to hold Public Hearing on November 14, 1984 at 7:00 p.m. in the Court* Roam of the 'Ibwn & County Bldg. Selectrren Gardner moved to approve, seconded QY SelectIren Clute, so voted.
