HomeMy WebLinkAbout1983-05-11 BOARD OF HEALTH Minutes of May 11, 1983 Meeting The Board of Health meeting commenced after a meeting as County Commissioners at 8:30 p.m. All members were present. Minutes of the May 4, 1983 meeting were approved as typed and reading of the same was waived on a motion from Skip Cabot, seconded by Jack Gardner, so voted. Rel ief from Covenant: Norma M. Minstrell: On August 1, 1980, Norma Minstrell at the direction of the Board of Health, signed a covenant combining in perpetuity two adjacent lots on Tennessee Avenue in Madaket. The convenant held that the two lots could only be subdivided thereafter "if at some future time the lots are served by public water supply and/or sewer systems," and then only with Planning board and Board of Health approvals. The Health Inspector was now requesting that this convenant be lifted as plans have been submitted to this office for two septic systems which are in total compl iance with both Madaket Regulations and Title Five. His letter concluded that "any further enforcement of this covenant would prolong a manifest injustice to the owner." Bernard Grossman asked if there were otehr lots not in compliance with Title 5. Mr. Ray said lots were unbuildable without a variance. None that he knew of. Jack Gardner moved to approve the lifting of the covenant, seconded by Bud Clute, so voted. Variance Request: Mitchell Todd Estate, A Street, Madaket: A letter from the Health Inspector to the Board recommending the following variances: 1. Title Five - State Sanitary Code: MCR 15.03 (7) (1) Distance from well to leach facil ity, 100 feet mandated, 75 feet available. 2. Title Five - State Sanitary Code: CMR 15.03 (7) (1) Distance from leach field to property 1 ine, 10 feet mandated, 1 foot available. 3. Madaket Regulations - Section 1, Distance from leach facility to well, 150 feet mandated, only 75 feet available. Mr. Ray explained that once again we are working with an undersized lot in Madaket. With the repairs proposed, distances will be increased over those of the failed system allowing a greater degree of environmental and resident protection without compromising the sanitary and well facilities of neighboring lots. He asked the Board to declare this an emeregency situation in order that work may commence immediately as this existing system has completing failed and may constitute an environmental hazard. Bernard Grossman moved to accept the recommendations of the Health Inspector, seconded by Jack Gardner, so voted. Jack Gardner moved to adjourn as there was no further business before the Board of Health, seconded by Kenneth Holdgate, Jr., so voted. Meeting adjourned at 8:35 p.m. BOARD OF HEALTH ~:~~ Chairman
