HomeMy WebLinkAbout1983-03-04 BOARD OF HEALTH Minutes of the March 4, 1983 Special Meeting This Special Meeting of the Board of Health commenced at 2:10 p.m. at the request of John Bernard's Attorney Robert Scandurra to continue the public hearing pursuant to the Board's vote of March 2, 1983. All members were present accept Charles J. Gardner. Mr. Bernard was not present, but represented by Attorney Scandurra. A letter was read from Richard Ray, the health Inspector, explaining that he had re- inspected the premises of 121 Orange Street on March 10, 1983 and commented that improvements had been made since the first inspection. There was now hot and cold running water, the bathroom floor had been replaced, and he noticed the beginnings of an interior general cleaning. He said further in his letter, that in view of this earnest effort to comply with our previous orders he found the structure to meet minimum standards of human habititation (with the emphasis on minimum). He further recommended that Mr. Bernard continue with improvements and the Building Inpsector, Fire Inspector and himself continue to perform inspections on a biweekly basis. Mr. Chaleki, the Building Inspector, said that there are still two structures which have to be removed; particularly a shed in the back which is going to collapse. He said he would have to demand they be removed in seven days or the Department of Public Works will have to remove it at a cost to the Town. Attorney Vaughan, Town Counsel, mentioned that Mr. Chaleki had given him 14 days to comply with the nine items in the letter to Mr. Bernard. One of the items has been repaired (the bathroom floor). Norman should wait seven days and take the next step. He said things must keep moving forward. Mr. Scandurra said he had spoken with Mr. Peterson who was at the premises and said he has promised to take care of it. Mr. Scandurra also said that Mr. Keating had John Bernard sign over a mortgage to him which Mr. Scandurra is presently trying to get back through probate court. Should the demolition of the buildings take place there will be some protection for the Town. Fa..re Chief, Bruce Watts, said there is still no hot water, but it is in a safe condition. Bernard Grossman asked the Board if they were contributing to the hazard as an attractive nuisance by not acting right away. Mr. Vaughan said that it was important to continue for that reason. He recommended a written report from Norman Chaleki two weeks from today as to the recommendations to be taken by the Board of Health. I Mr. Scandurra did add that Mr. Bernard has trespassers in his house of whom he has no control. They come while he is sleeping. He has no phone. He said he was going to call Chief McCormick to see to it that the house is patrolled. Bud Clute than made a motion to table a untiil..:the Board receives a progress report from Mr. Chaleki,and then set a deadline an orders from the Building Inspector., no later than one months time, seconded by Bernard Grossman, so voted.
