This meeting was called by Robert Scandurra, attorney for John ~rnard as a hearing on the order of the. Health Inspector to repair all heating facilities, plumbing facilities, hot water, and electrical services at 121 Orange Street. Heal th Inspector, Richard Ray, has served Mr. Bernard with this notice on January 31, 1983. Foley Vaughan, 'Ibwn Counsel, was present to question Mr. Ray and Mr. Bernard. He explained that upon order of the Health Inspector, Mr. Bernard now had the right to shay why this order should be reversed, rocrlifiErl or withdrawn. He explained it was up to the Board of Health to decide why to sustain or abstain the order. Mr. Ray explained that when he entered Mr. Bernard's house on January 27, 1983 with the Building Inspector and the Fire Chief he fotmd the house in disarray. The lighting was poor, there were holes in the ceilings, the gas stove was not flmctioning, the toilet facilities were being used, but were not working. There were four people living in the house at the time. Mr. Chaleki, the Building Inpsector, explained that he had gone through the hoose and had cane up with nine items that should be rEYTDved to ensure the safety of the inhabitants. Mr. Bernard's 14 days to respond to the order have I not expired. Chief Watts explained that there was a danger of fire. There was an old sp::ice heater in the house which Johnny has had since he owned the house. It was leaking, but they had saneone go dawn and fix it. Also the gas stove was not hooked up to the vent, nor was the hot water heater. Also the chimney is in need of rep::iir. These tmits go into this chilmey. Chief Watts said he had been back to the house, but not for a full inspection. Mr. Bernard accused Mr. Ray of going upstairs to examine the house wi thoot his permission. Mr. Ray explained that when he asked Mr. Bernard to accanpany him upstairq, Mr. Bernard was not feeling well so he went alone, but with permission. Mr. Scandurra said that his client should not be expected to canpl y to the ord~ irimediately. That the Board should be aware that Johnny will not be able to I get to all of it. He also spoke of the possibility that if the house is condemned, what do you do with four haneless people. Bernard Grossman moved that the Health Inspector's order be sustained by I the Board. Mr. Vaughan said that the seven days have really p::issed, therefore, he suggesterl a rrodification to the order. Possibly to give Mr. Bernard rrore time fran ' , tcrlay. Mr. Grossman said he was concerned with the structural problems. Mr. Chaleki suggested waiting for his canpliance. Possibly dohig them both together. The wiring inspector still needs to go down. Mr. Vaughan said the final inspection for the wiring, building, fire and health inspectors can be oral on the 25th of February. The Board of Health can meet on the 28th to hear fran everyone. Bernard Grossman moved to have final inspection February 25, 1983 , seconded by seconded by Bud Clute, so voted.
