All Members were present. Chairman Holdgate presided. Minutes of the Meeting of March 17, 1982 were accepted as typed and reading of the same was waived on motion by Mr. Gardner, seconded by Mr. Grossman, so voted. VARIANCE REQUEST: Topland Properties, Warrens Landing Road: Health Inspector Richard Ray's report was read wherein he recommended that the Granting of a I Variance from Health Code Requirements for a Leach Facility with the following i requirements be made: That as a condition of this Variance, the owners be reaui~ed to test the well quarterly each year with the results sent to his office and that the installation be supervised, on site, by an engineering firm of the owner's choice with "as built" drawings submitted to his office.Mr. Oliver I motioned that the recommendations of the Health Officer be accepted, seconded b~ IMr. Grossman, so voted. Mr. Gardner I motioned approval, seconded Mr. Oliver, so voted. i i I Chicken Box Letter: Letter from Robert R. Reed, Manager, Chicken Box Restauran~ read wherein he asks if a Permit can be issued for the sale of hot dogs from a I steamer lacated at the bar area of his establishment. He indicated that this would be a temporary measure until such time as his soon-to-be- renovated I kitchen receives proper approvals. Letter from Health Inspector Ray responding Ito Mr. Reed's letter read wherein he recommended that the Board deny this I request. That at a recent inspection he observed said steamer in use and he the1 informed Mr. Reed that he was in violation of the State Sanitary Code: CMR 590, I Subsection 590. 125A "Permits" which states: (a) Nor person shall operate a food service establishment unless he is the holder of a valid permit granted to i him by the Board of Health. Only a person who complies with the requirements of i these requlations shall be entitled to receive and retain such a Permit, which shall be posted on the premises of the food service establishment for which it is applicable. i I I I Mr. RaY'S letter continued. The Chicken Box holds, a Liquor License hut does not I I hold a Common Victualers License at this time- Should Mr Reed's letter be in I fact a request for a variance of this regulation, I would request that the Board deny such request for the following reason: In order to conduct the sale i lof non-pre-packaged foods (steamed hot dogs) an establishment must have a valid! I permit issued by the Board of Health. To be awarded such a permit, the establisH- ment must pass all rules of CMR 590 and 591, Rules and Regulations for Food SerJice Establishments. In its present condition, the establishment's kitchen would pas~ very few of the subject regulations. Mr. Grossman motioned that the recommenda- : tions of the Health Officer be followed, seconded by Mr. Gardner, so voted. I Board members then discussed the fact that although The Chicken Box All AlCOhOl~C I Annual License is of the Common Victualer category, the fact that presently a Common Victualer license has not been issued is to be considered. The Board directed Executive Secretary Bergman to check with the ABCC as to the procedure for changing this license to a General On Premise category.
