HomeMy WebLinkAbout1981-12-29 II BOARD OF HEALTH Minutes of the Meeting of December 29, 1981 The regular meeting of the Board of Health was called to order at 7:32 p.m. by Chairman Holdgate. All members were present. The Minutes of the Meeting of December 2, 1981 were accepted as typed. The Minutes of the Meeting of December 9, 1981 were accepted as typed. 1. Two-lot Subdivision; Low Beach Road; Owner - Elliot: Report received and read from Richard L. Ray, Health Inspector, on the subdivision at Low Beach Road, Tom Nevers, owned by Robert Elliot, noting the following: "Lot A was not tested as it has an existing dwelling with a functioning leach facility. Lot B is acceptable for septic system design with consideration given to the exact placement of the well and leach facility due to the proximity of the existing system and well on Lot A, the involvement of sections of Lot B with the Wetlands Protection Act, and breakout calculations as they apply to the bluff. However, I have researched the existing septic system on Lot A and found that it is potentially in violation of Title Five due to the proposed new subdivision line. With the placement of the new subdivision line, the owner has left his existing leach facility one foot from the proposed line. Title Five states that said leach facility must be ten (10) feet from a property line. Also, the septic tank has been left six (6) feet from the proposed property line, and the State stipulates that said septic tank must be ten (10) feet from a property line. It would appear that the property owner has two options available to him at this time: I 1. To relocate the proposed property line to comply with the State ',s mandated distance regulations concerning his existing septic system. ' 2. To leave the subdivision's property line in its proposed loca- tion and to remove the existing leach facility on Lot A and replace it in compliance with Title Five. Furthermore, I would request that the Board of Health reserve comment on I this proposed septic system until the owner's intentions concerning the above :1 noted situation are known. II In either event, new plot plans must be sumbitted to this office for re- evaluation." Jack Gardner stated that he believed Mr. Elliot plans to move the line. It is supposed to be set back a certain amount of feet and it is not. Bernard Grossman motioned to follow the recommendation of the Health In- spector. Seconded by Jack Gardner. So voted. 2. Ryder House, 66 Orange Street: Bernard Grossman brought up the subject of the Ryder House, 66 Orange Street, which was condemned last August. He stated that it doesn't look to him as if anything has been done to it. Richard Ray stated that as far as he knows, no engineer plans or permits have been taken out of Norman Chaleki's office. I Jack Gardner motioned to notify Norman Chaleki, Building Inspector, to I look into the situation and report back to the Board at next weeks meeting wit~ I a recommendation. Seconded by Don Oliver. So voted. ,I 3. Fire-damaged Structure Next to the Chicken Box: Bernard Grossman asked I if there was being anything done about the above mentioned structure. Richard Ray stated that he had not pursued any inspections and he didn't know of any repairs that were made. Roger Young motioned to have the Fire Chief, the Health Inspector, and the Building Inspector inspect the building and report back to the Board at next weeks meeting. Seconded by Don Oliver. So voted. Selectman Roger Young at this time made a motion to wish everyone a Happy New Year. Seconded by Bernard Grossman. So voted.
