BOARD OF HEALTH
Minutes of Meeting of December 10, 1980
This regular Board of Health Meeting commenced at 7:55PM after a brief session a
County Commissioners. Selectmen Young, Gardner, Knott and Oliver were present.
Chairman Ho1dgate was absent. Mr. Gardner presided as Acting Chairman.
inutes of the regular meeting of December 3, 1980 were accepted as typed and
reading of the same was waived on motion by Mr. Young, seconded by Mr. Knott, so
voted 3-0.
VARIANCE RE UEST FR~~ TITLE FIVE AND THE MADAKET REGULATIONS CAROL C. POWELL/
CORNER TENNESSEE AND K STREETS: Health Officer Richard Ray's report read wherei
estates t at lf granted, these Variances are from Title Five, Regulation 3.7
hich states that no well shall be located within one hundred feet of a septic
system and no leach facility shall be located within ten feet of a property line
and also from the Madaket Regulations, sections one and four, which state that
no leach facility shall be located within 150 feet of a well or 50 feet to a
property line.
~r. Ray recommended granting these Variances as follows: This is an undersized 1
ithin the boundaries and jurisdictions of the Madaket Regulations. The new pro-
osed location of the leach facility is a maximum distance from all wells in the
area and should afford no health hazards. (2) Due to the maximized distances of
ells and leach facility, it necessitates location of the leach within ten feet
he property line thus requiring a Variance from Title Five and the Madaket Regu1 -
tions. (3) This is an existing dwelling. Should these Variances not be granted,
aid dwelling must be considered uninhabitable. (4) This office has received
orrespondence from the Department of Environmental Engineering approving these
ariance Requests (attached to letter report).
r. Oliver motioned to accept the recommendations of the Health Officer, seconded
y Mr. Knott, so voted 3-0.

SSOCIATION read. This meeting will take place on December 11,1980 at Newton.

ents). Mr. Young motioned that permission be granted, seconded by Mr. Knott, s

here being no further business before the Board of Health, a motion to adjourn
t 7:59 was made by Mr. Young, seconded by Mr. Knott, so voted 3-0.
