Minutes of Meeting of November 4, 1980
This Board of Health Meeting for the purpose of further discussion regarding
proposed Well Regulations cOlTll1enced at 4:18 PM on November 4, 1980. All members
were present. Health Inspector Richard Ray and Building Inspector Chaleki were
present. ATTACHED AND A PART OF THESE MINUTES are (1) a copy of State Law sub-
mittedby Building Inspector and (2) Proposed Well Regulations as submitted by
Health Inspector Ray. Town Counsel has advised that the law be implemented.
Chairman Holdgate: No more Building Permits to be issued from this date on until
the law is complied with. Well driven and hand pump on well, we are set.
Testing water not required. Health Inspector Regulations come into effect. Not
what kind of water.
Chairman: Take another look at Health Inspector's Regulations.
Chaleki: What about request for Permits now on my desk.
Chairman: Comply with State Law before issuing.
Chairman: Write a letter giving 30 days notice on well water.
Motion by Oliver, seconded by Gardner. The Law is to take effect ilTll1ediately
and thirty days notice to get wells in that Permits have been issued on. So
voted 4-0.
Oliver: If you get in a pinch, come in for an extension beyond thirty days.
Ray: I want to go over the Well Regulations. (Will send in revised set of Well
Regulations.)
Chairman: No more septic systems be approved or designed until well system
approved. Write us a letter on this idea.
Chaleki: Require structure, well and septic system on the drawing or map before
occupancy permit.
Ray: Section II - out.
Section B - well point going bad. Prior written approval of DEQE.
Water Analysis - Hospital. Is being worked with by Health Inspector.
Test wells could be a possibility.
Motion to adjourn by Gardner. Seconded by Knott. Time: 5:00 PM.

PERMIT FOR EACH \iELL: EXISTING D'dELLING.
Apermit to construct or install a well to replace a failed water
supply w,ell to an existi,ng hal)itated dwelling shall be issued
within one work day of the Board of Health if said ne,., syste,
complies with all pertinent regulations of Title Five of the State
Sanitary Code.
In a case of non-compliance with Title Five an application for a
variance from Title Five must be made to the Department of Environ-
mental Quality Engineering.

RE: Availability of Water Supply
Dear Board Members:
Enclosed is a memorandum from the State Building Code Commission
forwarded to the Building Department in August of 1978.
At that time it was not customary practice to require proof of
availability of water before issuing a Building Permit because of the
availability of well water almost anywhere on the Island.
It is my intention to require compliance with M.G.L.A. Chapter 40,
Section 54 A and to request water well comp~etion reports to assure
availability of water to any structure which necessitates the use of water
therein, before the issuance of a Building Permit.
By requiring this information prior to the issuance of a Building
Permit, an Engineer would have the exact location of the well system and
could then properly locate the septic system on the property. Present
practice is to approve the location of the well and septic system on a
plan prior to determining if water is available at the particular location
selected for the well. This sometimes leads to relocation of both the well
and septic system from the originally approved locations, and in some instan-
ces the changes are not properly recorded.
It is my understanding a meeting is to be held on this subject
next Tuesday at 4:15 PM, I plan to attend and will answer any questions you
may have.

and Construction to inform all building officials of M.G. L.A. C. 40 S. 54A
which requires the written consent of the Executive Office of Transportation
and Construction before a building permit can be issued for structures to be
built on land formerly used as a railroad right of way.
