HomeMy WebLinkAbout1980-09-10 BOARD OF HEALTH Minutes of Meeting of September 10, 1980 This regular meeting of the Board of Health commenced at 7:37 PM. Selectmen Young Gardner, Knott and Oliver were present. Mr. Gardner presided as Acting Chairman. Mr. Holdgate joined the meeting at 7:50 PM. . Minutes of the regular Board of Health Meeting of September 3, 1980 were accepte as typed and reading of the same was waived on motion by Mr. Young, seconded by Knott, so voted 3-0. . Health Inspector Richard Ray's letter of request for permission to attend the CAPE AND ISLANDS' EMERGENCY MEDICAL SERVICES BOARD OF DIRECTORS MEETING on Friday'- September 12 was read. Mr. Ray then told the Board that he was withdrawing his request as it has turned out that Board of Health business will require his pres on Island Friday. Mr. John Shugrue addressed Board on behalf of Mrs. Rice. He said that she has owned this lot for 16 years. Owns no other property on Nantucket- only this one lot, an undersized lot of 5,000 sq. ft. Placement would restrict other lots in circles but this particular design is acceptable under Title Five. In that parti lar area in Surfside a pit has to be installed in cellar- submersible pump. Not really forcing placement of other houses in that area- JET pumps can be used. Mr. Braun an abutter with much adjacent lots. Nothing being polluted. Mr. Oliver motioned to reject the recommendations of the Health Officer, seconded by Mr. Kn tt, so voted 3-0. REQUEST FOR VARIANCE/MICHAELA EARLY/ALABAMA AVENUE, MADAKET: Richard Ray's repor read recommending denial of this request. That Madaket Regulations stipulate tha well must be located 150 feet from all leach facilities in area. This only 108. That abutters have right to be protected by 150 foot Regulation. An unidentified man addressed Board on Ms. Early's behalf. He said that Ms. Early inherited this lot from her father who bought it in 1952. That some abutters only have 35 feet between well and septic tank. That she can meet all of Madaket Regulations excep with this 108 foot distance. Mr. Gardner suggested that Ms. Early try.to negotia with neighbors. The spokesman said that Ms. Early is willing to pay for the movi of a neighbor's well. Mr. Ray cautioned that once someone agrees to move they mu t meet all regulations. Mr. Oliver said that if there is an absolute certainty tha can't make it, then would make a difference, but should try to negotiate first. Suggested the possibi 1 i ty of two lots using one well. Mr_ Ray said there are cas of this where an Easement of Perpetuity had been granted. I've checked this out with DEQE and its allowed as long as there is enough pressure to serve both houses. Mr. Young motioned that the Health Officer's recommendations be accepted. That Ms. Early try to negotiate with neighbors. Seconded by Mr. Oliver, so voted 4-0. PROPOSED TWO LOT SUBDIVISION/EDITH PERRY/OFF BARTLETT FARM ROAD: Richard Ray's reort read wherein he recommends that both lots are acceptable for septic system placement; that because of a clay layer experienced during perculation testing, ch leach field will require excavation of the clay from all sides of the leach facility as per Title Five of the State Sanitary Code. Both lots should be re-pi rce when more definitive house locations are selected. Mr. Gardner motioned that the Health Inspector's recommendations be accepted, seconded by Mr. Knott, so voted o. o PROPOSED REGULATIONS/1981/EXTERIOR CLEANING AREAS OF RESTAURANTS AND RETAIL FISH MARKETS: R1C ard Ray s report to the Boar rea whereln he lsts proposal for regu ations concerning the washing of mats and garbage cans on side streets, bac alleys and other unenclosed exterior areas to 'become effective in 1981. Mr. Ray also explained that he has received numerous complaints regarding this but polici of these situations have been difficult because regulations pertaining to food service establishments (Article 10) do not address these situations directly.The following are suggested: (1) All exterior cleaning pads should consist of: (a) a sealed concrete pad no less than 30 sq. ft. in area unless otherwise specified by the Nantucket Board of Health. Said pad shall have contoured sides sloping to a centrally located drain. (b) The drain shall be attahced to a cleanable grease trap before entering a sewer line or inground septic system. (2) Forced hot water shall be available at the cleaning pad. (3) Said cleaning area shall be enclosed BOARD OF HEALTH, Minutes of Meeting of September 10, 1980 (continued) Page 2 o PROPOSED REGULATIONS - 1981 (continued) subject to the Rules and Regulations of the Historic District Commission. (4) Violators of these regulations shall be subject to Regulation 39 (Penalties) of Article 10 of the STATE SANITARY CODE. If accepted, these Regulations shall be complied with before a 1981 Common Victu 1- ers License is issued. . A letter informing all restaurant and retail fish market owners will be sent upo approval. Mr. Knott motioned that these recommendations be accepted, seconded by Mr. Gardn r, so voted 4-0. There being no further business before the Board of Health, a motion to adjourn 8:05PM was made by Mr. Young, seconded by Mr. Knott, so voted 4-0. ~& Chairman o
