Minutes of Meeting of June 11, 1980
The Board of Health Meeting cOrmlenced at 7:45 PM after a brief session as County
COl11l1issioners. All members were present.

ttorney G, en addressed Boar. ecapped that Board recommended moving leach
facilities down to "green belt" area and then coming back for Variances. Mr.
Glidden said that he has recently talked with Healt~ Inspector Ray who has said
that the State would prefer the original- that that plan complied with State
regulations. Mr. Oliver said that he would still prefer to move it to the "gree
belt" area- that might run into future problems that are without a Ugreen belt"
boundary. Mr. Ray cautioned that swinging system down to ngreen belt" area
would be theorectically intruding in State's area of control. Then would require
not only Variance from Madaket Regulations but also State Title Five. State woul
merely tell us won't allow. Swing system back up to where it was. As far as Stat
is concerned, Madaket Regulations don't exist. Mr. Gardner asked for confirmatio
that legally system can fit into lot, except for Madaket Regulations, right? Mr.
Ray answered "right". Mr. Ray further said that he was not willing to change his
original recommendation, but did recommend a granting from Madaket Regulations
only. Mr. Gardner motioned that Mr. Carroll be granted a Variance from Madaket
Regulations, seconded by Mr. Oliver.
Mr. Young then asked Mr. Ray why he was opposed. Mr. Ray said that the Town is
looking for a means of control of building on this Island. This is one matter of
control. He also cautioned as to the fragility of the "water lens". That it is n t
getting enough recharge time now. It only has approximately six months to rechar e
itself. Chairman Holdgate asked Mr. Ray what happens if Town should put in a
water system out there in the future. Mr. Ray answered that the Madaket Regulati
would then be ineffectual. Vote was taken. Results 3-1, Mr. Young opposed.
~~ There being no further business before the Board of Health, a motion to adjourn
at 7:55 PM was made by Mr. Gardner, seconded by Mr. Oliver, so voted 4-0.
