Absent were Selectmen Young and Knott. inutes of the Board of Health Meeting of April 30, 1980 were accepted as typed nd reading of the same were waived on a motion by Mr. Gardner, seconded by Mr. liver, so voted 3-0. ARIANCE RE UEST FROM MADAKET REGULATIONS/DAVID FLEISCHER: Health Inspector Ray' eport concerning this existing 4 bedroom dwelling which presently has a failed eptic system contained the following information and recommendations: 1I...0nce again we are dealing with a small lot in Madaket with a failed ystem surrounded by existing dwellings with septic systems. Due to their proximi y, t is impossible for this lot to conform to Madaket Regulations. To deny these ariances would render this Lot uninhabitable. These Variances, if granted, are from Madaket Regulations, Section 1, hich states that no well shall be located within 150 feet on an existing leach ystem and also, from Regulation 4, which states that all leach systems' must be et back from property lines a distance of 50 feet. Re9ulation 1. I would recommend granting this Variance for the following easons: (a) to locate the well 150 feet from all systems in the area would place he well within 100 feet of the the leach facility on the lot to be served.(b)Tqa~ his Variance would be to allow the placement of a well and leach less than the adaket Regulations 150 feet but still within the State mandated 100 foot distanc s. Regulation 4. I would recommend granting this Variance for the following (a) due to the above stated situation in Regulation 1, the only availabl ocation for leach placement places the leach 12 feet from the property line. his satisfies the State mandated distance of ten foot setbacks but does not sati fy he stricter Madaket Regulations which require 50 foot setbacks.1I otion to accept the recommendations of the Health Officer was made by Mr. Gardne , econded by Mr. Oliver, so voted 3-0. here being no further business before the Board of Health, a motion to adjourn a :38 was made by Mr. Gardner, seconded by Mr. Oliver, so voted 3-0. ~//~ Kenneth W.
