BOARD OF HEALTH
Minutes of the Meeting of May 9, 1979
Meeting called to order at 8:13 p.m. following session of County Commissioners.
All members present.Minutes of the Meeting of May 2, 1979, were approved but
Board waived reading of the same.
Henrietta Thomas - Subdivision: Motion was made by Mr. Holdgate.'to approve
this proposed six lot subdivision as recommended by Health Inspector, Richard
Ray, and Schofield Brothers Inc., that is, with stipulation that an additional
deep hole soil test an~ perculation test be performed at the approximate
location of any further proposed sewerage disposal system on each lot.
seconded by Mr. Knott. So voted 4-0.
Hummock Pond Farms - Subdivison: Tw9 sets of plot Plans were presented to the
Board for approval: (1) a hypothetical proposal listing 40 lots along with
pertinent data that will be used as a basis for determining the number of lots
which are buildable in the definitive cluster plan; (2) a definitive cluster
subdivision. This being a plan of the actual subdivision as the developers
intend it geographically subdivided. Chairman Buckingham addressed those presen
as to the Board's limitations of approval whereas the Wetlands Protection Act
prevails and that the final decision must be made by the Commission empowered
to enforce this Act, The Conservation Commission. Health Inspector, Richard
Ray, displayed copies of both plot plans and a grid map. He advised the public
that the Board was strictly concerned with Title Five and that personal opinio
do not apply. Mr. Wayne Jaquith, Nantucket LaDd Council, Inc., addressed the
Board as to the severe soil problems in the area and requested the Board to
make recommendations to the Planning Board and Zoning Board of Appeals to
stipulate condidition of one dwelling per lot. He also advised the Board that
plot plan (1) was a new plan and not the plan submitted to the planning Board.
Mr. Gardner commented that the Board of Health does not make recommendations
to the Planning Board, a separate entity! Mr. Visco, Planning Board, said he
saw nothing wrong with plot plan (1), that it was only hypothetical to ease
the determination of buildable lots and that the plan before the Planning
Board was for the cluster development. Mr. Carl Bochert requested the Board
to advise the Conservation Commission that the plot plan (1) is different
from that submitted to the Planning Board because there is a timing problem
on the Commission and Planning Board meeting dates and that possibly the
Planning Board could be requested to table this for a week allowing the
Conservation Commission time to review. Mr. Holdgate then moved that the
proposed subdivision and the recommendations of the Health Inspector be
referred to the Conservation Commission. Mr. Gardner seconded the motion with
the ammendment that the Conservation Commission be advised that plot plan (1)
is not the plan submitted to the Planning Board. So voted 4-0.
There being no further busine8s, the Board of Health adjouraed to meet as the
Board of Selectmen at 8:45 p.m. on a motion from Mr. Knott, seconded by Mr.
Gardner. So voted 4-0.
